I 21 22 8-02.3(3)A Chemical Pesticides 23 Chemical pesticides include, but are not restricted to, any substance or mixture 24 of substances intended for preventing, destroying, repelling or mitigating any I 25 pest, including but not limited to, insecticides, herbicides, fungicides, adjuvants, 26 and additives. including plant regulators, defoliants and desiccants. The 27 Contractor shall apply chemical pesticides in accordance with the label I 28 recommendations, the Washington State Department of Ecology, local sensitive 29 area ordinances, and Washington State Department of Agriculture laws and 30 regulations. Only those pesticides listed in the table Herbicides Approved for Use I 31 on WSDOT Rights of Way and accepted as part of the Weed and Pest Control 32 Plan or by written authorization from the Engineer may be used 33 (www.wsdot.wa.qov/maintenance/roadside/herbicide use.htm). 34 I 35 The applicator shall be licensed by the State of Washington as a Commercial 36 Applicator or Commercial Operator, with additional endorsements as required by 37 the Special Provisions or the proposed weed control plan.All chemical pesticides I 38 shall be delivered to the job site in the original containers, or if pre-mixed off-site, 39 a certification of the components and formulation from the supplier is required. 40 The licensed applicator or operator shall complete WSDOT Form 540-509, I 41 Commercial Pesticide Application Record, each day the pesticide is applied and 42 furnish a copy to the Engineer by the following business day. 43 44 The Contractor shall ensure confinement of the chemicals within the designated 45 areas. The use of spray chemical pesticides shall require the use of anti-drift and 46 activating agents and a spray pattern indicator unless otherwise allowed by the 47 Engineer.
