(d) Appeal and Appeal Board -- Any such Fire Marshal <br /> Order shall be forthwith complied with as set <br /> forth in said order within the time or times <br /> therein prescribed. Any person upon whom such <br /> order is served, may, within five days after <br /> the service of such order, take an appeal of <br /> such order and seek review thereof with the <br /> Fire Prevention Review Board. <br /> 1 . There is hereby created a Fire Prevention <br /> Review Board, which Board shall be com- <br /> posed of the following officials of the City <br /> of Everett, to-wit : <br /> Commissioner of Safety, as Chairman <br /> City Building Inspector <br /> Chief of the Everett Fire Department <br /> City Clerk of the City of Everett. <br /> 2. Duties of the Clerk -- It shall be the <br /> duty of the Clerk of the City of Everett, <br /> as a member of the said Fire Prevention Review <br /> Board, to have on hand in his office forms for <br /> appeal from such Fire Marshal Orders. The <br /> said Clerk shall keep a record of all such <br /> appeals, shall have authority to schedule hear- <br /> ings or dates for review of such Fire Marshal <br /> Orders before such Fire Prevention Review <br /> Board, and shall keep the records of the Fire <br /> Prevention Review Board, its sessions, the <br /> dates thereof, the members present and the <br /> witnesses heard giving testimony in each <br /> particular case. <br /> 3. Steps on Appeal -- Any person upon whom <br /> such Fire Marshal Order has been served <br /> who desires to appeal the order therein set <br /> forth and review such order may do so, so long <br /> as such person shall comply with each and every <br /> step herein set forth, which jurisdictional <br /> steps are as follows : <br /> (a) File two copies of notice of appeal <br /> with the City Clerk of the City of <br /> Everett within five days after <br /> service of said Fire Marshal Order; <br /> and <br /> (b) Post the sum of $25.00 with the <br /> City Clerk to cover cost of appeal . <br /> 4. In the event that any such person seeking <br /> a review before the Fire Prevention Review <br /> Board fails to comply with all of the steps <br /> herein set forth, then any member of said Fire <br /> Prevention Review Board or the City Attorney <br /> for the City of Everett may dismiss such appeal <br /> upon motion and if all of the steps for appeal <br /> have not been complied with, the appeal of such <br /> party shall be dismissed by the Fire Prevention <br /> Review Board. <br /> -5- <br />
