destruction of any Water Department 1aipp, valve, service, hydrant, meter 4 <br /> nor any other appurtenance, unit or facility which forms a part of the Water <br /> System. Any person causing or responsible for damage and/or destruction <br /> of any Water Department facility whatsoever shall pay all costs for repair or <br /> replacement of such facility and shall further be deemed guilty of and subject <br /> to prosecution for a misdemeanor. <br /> Section 84: Treatment of Water - Authority To Specify. The <br /> Washington State Department of Health, acting through the Snohomish Health <br /> District, shall have the authority to specify the type and degree of treatment <br /> to be applied to all waters of the Everett System. <br /> Section 85: Lien For Delinquent Water Charges. The Water Depart- <br /> ment elects to claim and does hereby claim a lien in the manner provided by <br /> Chapter 135, Laws of Washington, 1933, (R. C,W. 35. 21. 290) as now amended <br /> or as the same may be hereafter amended, for all delinquent and unpaid charges <br /> for water and special charges against the premises to which the same has been <br /> furnished; provided, that the owner of said premises, or the owner of a delin- <br /> quent morgage thereon, may give written notice to the Superintendent or other <br /> head of such works or plants to cut off service to said premises and from and <br /> after the giving of such notice and the payment or tender of the then delinquent <br /> and unpaid charges against such premises for such service together with the <br /> cut off charge, the Water Department shall have no lien on the premises for <br /> charges for such services thereafter furnished, nor shall the owner, or the <br /> owner of a delinquent mortgage thereon, be held for the payment thereof; <br /> provided further, that such liens shall not be for more than four months charges <br /> due or to become due, nor for any charges which have been due for more than <br /> four months, unless such limitation be waived. The enforcement of this lien <br /> shall be by cutting off the service until the delinquent and unpaid charges are paid. <br /> Section 86: Ordinance Violations - Penalty. Any person violating any <br /> of the provisions of this Ordinance shall be deemed guilty of a misdemeanor, <br /> -39- <br />
