Traditionally, human <br /> activity has been permitted in some areas of the Chaplain Tract,while other areas have been closed entirely, <br /> particularly within the Chaplain Reservoir Watershed Boundary,because human activity in these areas could <br /> jeopardize water quality. Currently, human activity within the Chaplain Tract is regulated by several Everett <br /> Municipal Code chapters,which have potentially conflicting language. The proposed ordinance resolves this <br /> by enacting a single chapter to: 1) Clearly identify those areas of the Chaplain Tract where human activity is <br /> permitted (to be called Chaplain Tract North) and those areas where it is not (to be called Chaplain Tract <br /> South;) 2) Clearly regulate human activity in those areas where it is permitted by setting out which activities <br /> are allowed and which activities are not; and 3) Define violations as punishable by either criminal or civil <br /> penalties based on their relative severity and risk to water quality and public safety. <br /> RECOMMENDATION: <br /> Adopt an Ordinance relating to Regulation of the Chaplain Tract and Watershed,Repealing Ordinances in <br /> accordance with Section 30 of this Ordinance. <br /> 1 <br />
