• <br /> l - <br /> ORDINANCE NO. <br /> An Ordinance relating to Regulation of the Chaplain Tract and Watershed, <br /> Repealing Ordinances in accordance with Section 30 of this Ordinance. <br /> Whereas, City owned property now collectively referred to as-and commonly known as <br /> the "Chaplain Tract" is regulated by separate ordinances for Watershed (Chapter 14.24 EMC), <br /> Chaplain Watershed Protection(Chapter 8.46 EMC), and Chaplain Tract Public Access(Chapter <br /> 8.47 EMC); and, <br /> Whereas, regular review of these ordinances identified potentially conflicting language <br /> among such ordinances and also with other chapters of the Everett Municipal Code; and <br /> Whereas,preservation and enhancement of water quality in the Chaplain Tract, as well <br /> as within the entire Sultan Basin, are of paramount importance to the City's ability to provide <br /> adequate safe drinking water to those in its service area and to protect important resources; and <br /> Whereas, a single ordinance regulating all lands within the Chaplain Tract, including <br /> both areas where public access is pelu►itted and where it is prohibited,promotes this purpose by <br /> clarifying the regulated areas and enhancing the criminal and civil enforcement regulations for <br /> the Chaplain Tract;and <br /> Whereas,the Chaplain Tract is owned and managed by the City of Everett,Public Works <br /> Department,and all municipal ordinances apply to the property, and <br /> Whereas,the City of Everett provides domestic drinking water to approximately 560,000 <br /> residents(80 percent)of Snohomish County;and <br /> Whereas,the Washington State Board of Health Drinking Water Regulations require that <br /> water purveyors obtain drinking water from the highest quality source feasible, with purveyors <br /> obligated to identify and monitor those conditions and activities which adversely affect source <br /> water quality and make recommendations for improved watershed control (WAC 246-290-668); <br /> and, <br /> Whereas, the City's water supply has been located approximately 20 miles east of <br /> Everett in the Sultan Basin since the early 1900s, comprised of all water resources located within <br /> the hydrologic boundary of the Sultan Basin including Spada and Chaplain Reservoirs and the <br /> Sultan River and its tributaries above the City diversion dam, and those lands encompassed <br /> within the hydrologic boundary of Chaplain Reservoir that are owned by the City of Everett; and <br /> 2 <br />
