1 <br /> Whereas, the City's domestic water supply system consists of dams at Chaplain and <br /> Spada Reservoirs; a City diversion dam and tunnel along the Sultan River; a Snohomish County <br /> Public Utility District (PUD) tunnel, penstock, and water pipelines which provide storage and <br /> conveyance for the domestic water supply; and a filtration plant constructed at Chaplain <br /> Reservoir; and, <br /> Whereas, portions of the Chaplain Tract are managed under an agreement between <br /> Washington Department of Fish and Wildlife,the Public Utility District (PUD,) and the City for <br /> conservation of wildlife habitat;and <br /> Whereas,human activities adjacent to Chaplain Reservoir jeopardizes water quality,and <br /> therefore these Iands surrounding Chaplain Reservoir and north of the fenced security gate at the <br /> City filtration plant and north of the Diversion Dam on the Sultan River should be closed to <br /> human activity at all times;and <br /> Whereas, the areas south of the fenced security gate at the City filtration plant and the <br /> areas south of the Diversion Dam on the Sultan River have traditionally been open to the public <br /> for limited day use; and several areas are required to have public access for limited recreational <br /> day use by order of the FERC license for the Henry M. Jackson Hydroelectric Project (FERC <br /> 2157); and these areas are defined as River Access Areas in the Jackson Project Recreation <br /> Resource Management Plan; and <br /> Whereas, those areas of the Chaplain Tract open to public use should be governed by <br /> responsible regulations designed to protect the areas from environmental degradation. <br /> NOW,TH IIREFORE,TH H; CITY OF EVERETT DOES ORDAIN: <br /> Section 1: <br /> Short title. <br /> This shall be known and may be cited as the"Chaplain Tract"chapter. <br /> Section 2: <br /> Purpose. <br /> The purpose of this chapter is to protect the public health,safety, and welfare of those residents <br /> within the Everett water service area and provide a safe and environmentally sound public access <br /> program for the areas of the Chaplain Tract on which it is allowed. Specifically,this chapter <br /> seeks to protect public health and safety by regulating human activity located within the City- <br /> owned Chaplain Tract. <br /> 2 <br /> 3 <br />
