3 <br />ORDINANCE NO. <br />AN ORDINANCE Relating to the National Electric Code, <br />Amending Part 7, Section 1 of Ordinance No. 3196-10 (EMC 16.05). <br />Whereas, The National Electric Code (the "NEC") is part of the State Building <br />Code, which is in effect in all Washington cities and counties; and <br />Whereas, in the past, the City has amended the NEC to restrict the type of <br />wiring allowed for use in the construction of non -dwelling occupancies; and <br />Whereas, the City Council finds that the City's more restrictive requirement is <br />not necessary to protect the public health, safety, and welfare; and <br />Whereas, the City Council finds that it is appropriate to eliminate this <br />requirement; <br />NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br />Section 1. Subsection B of Section 1 of Part 7 of Ordinance No. 3196-10 (EMC <br />16.05.010), entitled "Amendments to the National Electric Code (hereinafter referred <br />to as the "NEC")," which reads as follows: <br />B. WAC 296-46B-155 of the Department of Labor and Industries rules and <br />regulations for installing electric wires and equipment and administrative rules as <br />herein adopted is hereby amended by adding the following: <br />Regardless of any other provisions in this chapter, NM, NMS, NMG, SE, and <br />USE cable shall not be allowed in non -dwelling occupancies. For the purpose <br />of this section motels, hotels, and the facilities listed in tables 1 and 2 (WAC <br />296-46B-901) are not considered to be dwelling occupancies. Family child <br />daycare homes are exempt from this section. <br />Be and the same is hereby deleted. <br />Section 2. Severability <br />Should any section, subsection, paragraph, sentence, clause, ph <br />rase, or portion of <br />this Ordinance or its application to any person or situation, be declared <br />unconstitutional or invalid for any reason, such decision shall not affect the validity of <br />the remaining portions of this Ordinance or its application to any other person or <br />situation. The City Council hereby declares that it would have adopted this Ordinance <br />and each section, subsection, paragraph, sentence, clause, phrase, or portion <br />thereof irrespective of the fact that any one or more sections,• subsections, <br />paragraphs, clauses, phrases, or portions be declared invalid or unconstitutional. <br />16 <br />
