c <br />t o7v Pe i <br />January 20, 1988 <br />tYe =,ercreen <br />elry oe <br />Kathy Feris everett <br />c/o Stewart Title <br />3224 Wetmore Avenue <br />Everett, Washington 98201 PUBLIC WORKS DEPARTMENT <br />32CO CEDAR STREET <br />Subject: Driveway Curb -Cut at 3224 Wetmore Avenue EVERETT, WASHINGTON <br />98201 <br />Dear Ms. Feris: <br />The Everett Municipal Code (Section 13.16.120) states in part "whenever the <br />use of the driveway shall be discontinued, the owner of the abutting oroperty <br />shall, upon notice from the City Council remove the driveway approach and <br />replace the sidewalk and public property in accordance with City <br />specification...". <br />It was not clear in our initial review in 1986 of this conversion of a parking <br />garage to an office whether the existing driveway curb cut was to be <br />utilized. There was no mention of discontinued u_,e on the plans that were <br />submitted to our department. It is not unconceivable that it was the owner's <br />intention to utilize this area as a load -unload area for clients and <br />supplies. Therefore, a requirement to remove this curb -cut was not included <br />in the permit process. <br />Likewise, it is possihle that the parking enforcement pers n could not tell if <br />this driveway is utilized for load -unload, etc. <br />Therefore, if the property owner Joes not wish to use this driveway then he is <br />required by the Everett Municipal Code, as sighted above, to apply for a <br />Public Works Permit and remove the driveway at his expense.
