CITY <br /> RIGHT OF ENTRY AND <br /> TEMPORARY CONSTRUCTION EASEMENT <br /> REAL ESTATE MANAGER PROJECT: WO #3688 <br /> 3200 CEDAR STREET PROPERTY: 1520 41St Street, Everett, WA <br /> EVERETT, WA 98201 GRANTOR: Brust Development Co. LLC <br /> This agreement made this aq day of &+OtJey 2019,by and between Brust <br /> Development Co. LLC, a Washington limited liability company, (hereinafter referred to as <br /> "Owner"),in exchange for valuable consideration, hereby grants permission to the City of <br /> Everett, (hereinafter referred to as "City") its authorized agents, assigns, or subcontractors,to <br /> enter upon certain land, for the purposes of construction, construction storage and staging in <br /> connection with the City's Pacific Avenue to Interurban Trail Bicycle Safety project(WO <br /> #3688), ("Project") subject to the conditions set forth herein and subject to all matters of record. <br /> The land to which this construction agreement applies is set forth in drawing"Exhibit A", <br /> attached hereto and incorporated herein by reference (herein after referred to as the"Property"). <br /> The rights of the City under this agreement are coupled with an interest on the part of the City <br /> and therefore may not be revoked prior to expiration. <br /> The Owner and the City, by granting and accepting this temporary construction easement <br /> respectively,mutually covenant and agree as follows: <br /> 1. The City will make reasonable efforts to minimize disruption and inconvenience to said <br /> property and uses made thereof. <br /> 2. As necessary for the project,the City has the right to relocate, move, set aside, or displace <br /> Owner's personal property that restricts or hampers the construction of this project, over, <br /> under and upon the lands of the Grantor. <br /> 1 of 7 <br />
