3. As necessary for the project,the City has the right to remove landscaping, as shown on <br /> the attached Exhibit"A". <br /> 4. The City shall, upon completion of construction of said project described herein,remove <br /> all debris and restore the surface of the Property as nearly as possible to the condition <br /> immediately prior to the City's entry thereon excepting any modifications or <br /> improvements made as part of the construction project. The City shall not re-sod any <br /> portion of the landscaping on the Property but shall reimburse the Owner for any <br /> reasonable expense in connection with re-installation of sod. <br /> 5. The temporary rights herein granted shall have a duration of not more than four months <br /> and terminate upon completion of construction activities or on March 1, 2020, whichever <br /> occurs first. <br /> 6. The City shall ensure that all work performed on the Property, if any, shall be performed <br /> in accordance with any and all applicable laws or other governmental requirements. <br /> 7. The City shall in no event cause or permit the release of any hazardous substances on the <br /> Property. <br /> 8. The City accepts the Property in its "as-is" condition without any implied warranty of <br /> merchantability or fitness for a particular use, with all faults and defects, latent and <br /> otherwise, and shall assume the risks that adverse physical conditions may not have been <br /> revealed by its investigation. <br /> 9. Prior to commencing any work on the Property and throughout the term of this easement, <br /> the City shall obtain and keep in place its customary insurance coverage for work of this <br /> scale and character. <br /> 2 of 7 <br />
