7:77- RESOLUTION NO. A RESOLUTION authorizing recovery of abatement costs pursuant to EMC 1.20.090 at 929 Pecks Drive,Everett,Washington. WHEREAS,the Everett Municipal Code (the"EMC") Section 1.20.090 authorizes the City to abate code violations and recover the abatement costs; and WHEREAS,on November 15, 2012,the City of EverettViolations Hearing Examiner issued an Order against the property owner(the"Respondent")for EMC violations at 929 Pecks Drive(the"Property"),parcel number 00393200702002, and abbreviated legal description: BEVERLY HILLS DIV 4 BLK 007 D-02 BLK 7 LOT 20 LESS W 70FT ALSO LESS 6FT THOF PER SWD 853/346 WHEREAS the Respondent failed to abate the violations, including garbage,trash, household items,bicycles, automotive parts and salvage materials accumulating on the exterior of the property,by the date set by the Order. WHEREAS,the property owner agreed that the City would abate the violations at his cost, and that those costs together with any penalties imposed by the Hearing Examiner may become a lien against his property if he failed to reimburse the City the abatement costs. WHEREAS,the City incurred costs in the amount of$2,618.94 in its abatement of the violations and attorney's fees and other costs in the amount of$391.50 and the Hearing Examiner imposed a penalty of$1,500 against the Respondent; and WHEREAS,notice of Council's consideration of this Resolution was provided to the property owner; NOW, THEREFORE,BE IT RESOLVED by the City Council of Everett that the costs and penalties set forth in the report attached hereto is confirmed for the Property. The City Treasurer is authorized to certify the amount due and owing to the County Treasurer, which amount shall then be entered as an assessment upon the tax rolls against the Property with interest as provided by law.
