• <br /> 4 <br /> • <br /> ORDINANCE NO. <br /> An Ordinance relating to Chronic Nuisance Properties, amending <br /> Ordinance No. 3091-08_ <br /> WHEREAS,RCW 35.22.280 empowers first class cities to define and abate nuisances and <br /> impose fines upon persons responsible for creating or allowing nuisances; and <br /> WHEREAS, certain property owners or persons in charge of properties allow the properties to <br /> deteriorate physically and aesthetically and/or be used for illegal and nuisance activity,thereby <br /> becoming Chronic Nuisance Properties and interfering with the health, safety, and welfare of the <br /> residents of the surrounding neighborhood, as well as, reducing neighboring property values and <br /> desirability; and <br /> WHEREAS, ordinary enforcement of City ordinances, both through code and criminal <br /> enforcement, does not always adequately address Chronic Nuisance Properties; and <br /> WHEREAS,the Everett City Council adopted Ordinance No. 3091-08,the City's Chronic <br /> Nuisance Ordinance, to provide a mechanism for the City to address Chronic Nuisance <br /> Properties by first providing the person in control of the property an opportunity to resolve the <br /> Nuisance Activity and ultimately initiating civil actions to force compliance with City <br /> ordinances; and <br /> WHEREAS,recent experience utilizing the Chronic Nuisance Ordinance has demonstrated that <br /> some changes will increase its efficiency and address Nuisance Activity not currently defined by <br /> the Ordinance; and <br /> WHEREAS,in the experience of the Police Department possession of stolen property by <br /> persons associated with a Chronic Nuisance Property is indicative of a Person in Charge of the <br /> Property's allowing illegal activity that poses a significant health, safety, and welfare threat to <br /> the surrounding neighborhood because individuals and businesses in the surrounding <br /> neighborhood are likely victims of property crimes; and <br /> WHEREAS,Nuisance Activity associated with a Property over twelve months, although not <br /> meeting the threshold of three events in a sixty-day period, have significant health, safety, and <br /> Page l of 11 <br /> 6 <br />
