G. Valid Land Use for Subdivision. As required by RCW 58.17.170, a subdivision shall be <br /> governed by the terms of the approval of the final plat, and any lots created thereunder shall be a <br /> valid land use not withstanding any change'in zoning laws for a period of five years from date of <br /> filing, unless the city council finds that a change in conditions in the subdivision creates a serious <br /> threat to the public health or safety. <br /> Is hereby amended to read as follows: <br /> Time periods and expiration of land division approvals. <br /> A. Expiration of Preliminary Subdivision or Cluster Subdivision or Cluster Short Subdivision <br /> Approval. Final subdivision or cluster subdivision or cluster short subdivision approval must be <br /> obtained within five seven years of the date of of preliminary subdivision approval if the date of <br /> preliminary approval is on or before December 31, 2014, and within five years of the date of <br /> preliminary approval if the date of preliminary approval is on•or after January 1, 2015, after <br /> which time the preliminary approval will be void. An extension may be granted by the city for <br /> one year if the applicant has attempted in good faith to submit the final plat within the five-year <br /> time period; provided,however,that the applicant files a written request with the director <br /> requesting the extension at least thirty days before expiration of the five-year period. <br /> B. Expiration of Preliminary Short Subdivision or Preliminary Binding Site Plan Approval. <br /> Final short subdivision or final binding site plan approval must be obtained within five seven <br /> years of the date of preliminary approval if the date of preliminary approval is on or before <br /> December 31,2014. and within five years of the date of preliminary approval if the date of <br /> preliminary approval is on or after January 1, 2015, after which time the preliminary approval <br /> will be void. An extension may be granted by the city for one year if the applicant has attempted <br /> in good faith to submit the final short plat or binding site plan within the five-year time period; <br /> provided, however,that the applicant files a written request with the director requesting the <br /> extension of at least thirty days before the expiration of the five-year period. <br /> C. Expiration of Preliminary Subdivision Alteration or Vacation Approval. Final subdivision <br /> alteration or vacation approval must be obtained within five seven years of preliminary <br /> subdivision alteration or vacation approval if the date of preliminary approval is on or before <br /> December 31, 2014, and within five years of the date of preliminary approval if the date of <br /> preliminary approval is on or after January 1, 2015, after which time the preliminary approval <br /> will be void. An extension may be granted by the city for one year if the applicant has attempted <br /> in good faith to submit the final plat alteration or vacation within the five-year time period; <br /> provided, however,the applicant must file a written request with the director requesting the <br /> extension at least thirty days before expiration of the five-year period. <br /> D.
