CITY OF EVERETT SPECIAL PROVISIONS <br /> If the City has made subsurface investigation of the site of the proposed Work, the <br /> boring log data and soil sample test data accumulated by the City will be made <br /> 1 available for inspection by the Bidders. The boring logs and soil sample test data <br /> shall NOT be considered as part of the Contract. In addition, the City makes no <br /> representation or warranty expressed or implied that: <br /> 1. The Bidders' interpretations from the boring logs are correct, <br /> 2. Moisture conditions and indicated water tables will not vary from those <br /> found at the time the borings were made, and <br /> 1 3. The ground at the location of the borings has not been physically <br /> disturbed or altered after the boring was made. <br /> Supplement 1-02.4(2) by adding the following: <br /> The boring log data and soil sample data, if any, can be found in Appendix A. <br /> If there is a geotechnical report made by the City, Bidder may contact City of Everett <br /> Project Manager to arrange to view the geotechnical report. <br /> 1-02.5 Proposal Form <br /> Delete this section and substitute the following: <br /> ' The Proposal Form identifies the project and its location and describes the work. It also <br /> lists estimated quantities, units of measurement, the items of work, and the materials to <br /> be furnished at the unit bid prices. The Bidder shall complete spaces on the proposal <br /> form that call for, and are not limited to, unit prices; extensions; summations; the total <br /> bid amount; signatures; date; and, where applicable, retail sales taxes and <br /> acknowledgment of addenda; the bidder's name, address, telephone number, and <br /> signature; the bidder's UDBE/DBE/M/WBE commitment, if applicable; a State of <br /> Washington Contractor's Registration Number; and a Business License Number, if <br /> applicable. Bids shall be completed by typing or shall be printed in ink by hand, <br /> preferably in black ink. The required certifications are included as part of the Proposal <br /> Form. <br /> Bidder shall submit Bidder's Proposal on the Proposal Form provided in the Contract <br /> Documents. <br /> 1 1-02.6 Preparation of Proposal <br /> Delete "unless it approves in writing" from the second sentence of the first paragraph of 1- <br /> 02.6. <br /> Revise the fourth paragraph of 1-02.6, beginning with "The Bidder shall submit with the Bid <br /> a completed", to read as follows: <br /> Contractor agrees that the Contractor shall actively solicit the employment of minority <br /> group members. Contractor further agrees that the Contractor shall actively solicit Bids <br /> for the subcontracting of goods or services from qualified minority businesses. <br /> Contractor shall furnish evidence of the Contractors compliance with these <br /> requirements of minority employment and solicitation. Contractor further agrees to <br /> consider the grant of subcontracts to said minority bidders on the basis of substantially <br /> equal proposals in the light most favorable to said minority businesses. The Contractor <br /> shall be required to submit evidence of compliance with this section as part of the Bid. <br /> As used in this section, the term "minority business" means a business at least 51 <br /> percent of which is owned by minority group members.
