CITY OF EVERETT SPECIAL PROVISIONS <br /> 1-04.1(3)D Utilities I <br /> 1-04.1(3)13(1) General <br /> The City has endeavored to determine the existence of public and private <br /> utilities at the site of the Work from the records of the owners of known utilities <br /> in the vicinity of the Work. The positions of these utilities as derived from such <br /> records are shown on the Plans. Unless otherwise noted, no excavations were <br /> made to verify the locations shown for underground utilities. The service <br /> connections to the gas, electric, cable TV and communication utilities are not <br /> shown on the Plans. Refer to 1-07.17 UTILITIES AND SIMILAR FACILITIES <br /> regarding Contractor's responsibility for locating and verifying underground <br /> public and private utilities. <br /> 1-04.1(3)13(2) Unknown/Incorrectly Marked Utilities <br /> When a utility interferes with the Work and is either (1) not identified on the <br /> Plans or (2) located in a position significantly different from that specified on <br /> the Plans or in accordance with a particular utility's standard depth and location, <br /> Contractor shall follow the procedures of 1-04.7 DIFFERING SITE <br /> CONDITIONS (CHANGED CONDITIONS). Interference with the Work is <br /> defined as a utility that crosses or projects into the plane of the Work at an <br /> elevation between the top and bottom of the Work. <br /> 1-04.2 Coordination of Contract Documents, Plans, Special Provisions <br /> Specifications, and Addenda <br /> Revise the second paragraph of 1-04.2 to read as follows: <br /> Any inconsistency in the parts of the Contract shall be resolved by following this order <br /> of precedence: <br /> 1. Change Orders, <br /> 2. Addenda, <br /> 3. Contract, <br /> 4. Proposal Form, <br /> 5. Special Provisions, <br /> 6. Contract Plans, <br /> 7. City's Standard Drawings (if any) <br /> 8. WSDOT/APWA Standard Specifications for Road, Bridge, and Municipal I <br /> Construction, <br /> 9. Amendments to WSDOT Standard Specifications for Road, Bridge, and <br /> Municipal Construction, and 1 <br /> 10. WSDOT/APWA Standard Plans for Road, Bridge and Municipal Construction. <br /> Revise the seventh paragraph of 1.04.2 to read as follows: <br /> In case of any ambiguity or dispute over interpreting the Contract, the Engineer's <br /> decision will be final as provided in 1-05.1 AUTHORITY OF THE ENGINEER. <br /> 1-04.3 Reference Information <br /> Revise 1-04.3 to read as follows: <br /> Reference Information provided to the Contractor is not part of the Contract. The City of <br /> Everett does not guarantee the accuracy of the Reference Information and is not <br /> responsible for the content of the Reference Information in any manner.
