CITY OF EVERETT SPECIAL PROVISIONS <br /> ' Point of manufacturing inspection will be required if: <br /> Inspection and testing of materials or Equipment in the vicinity of the Work by the <br /> City is not practicable, <br /> The Contractor requests the City to inspect and test material or Equipment at the <br /> point of manufacture, or <br /> ' The Standard Specifications or these Special Provisions require that inspection, <br /> testing or witnessing of tests take place at the point of manufacture. <br /> 1-06.4 Handling and Storing Materials <br /> Supplement 1-06.4 by adding the following: <br /> Contractor shall store materials and Equipment so as to insure the preservation of their <br /> quality and fitness for the Work. Store Equipment and materials at location that <br /> facilitates inspection. The Contractor shall be responsible for damages, loss or casualty <br /> occurring to materials and Equipment until Final Acceptance. <br /> 1-06.6 Recycled Materials <br /> Delete 1-06.6 and its subsections and substitute the following: <br /> Make best effort to utilize recycled materials in the construction of the project as detailed <br /> ' in elsewhere in the Standard Specifications and these Special Provisions. <br /> Prior to Physical Completion report the quantity of recycled materials utilized in the <br /> construction of the project for each of the items listed in Section 9-03.21. Include hot <br /> ' mix asphalt, recycled concrete aggregate, recycled glass, steel furnace slag and other <br /> recycled materials (e.g. utilization of on-site material and aggregates from concrete <br /> returned to the supplier). Provide report on DOT form 350-075 Recycled Materials <br /> ' Reporting. <br /> 1-07 LEGAL RELATIONS AND RESPONSIBILITIES TO THE PUBLIC <br /> 1-07.1 Laws to be Observed <br /> Revise 1-07.1 by replacing "WSDOT" with "City" in the next to the last sentence of paragraph <br /> three. <br /> ' Supplement 1-07.1 by adding the following: <br /> The Contractor shall be in compliance with all applicable standards, orders, or <br /> requirements issued under Section 306 of the Clean Air Act[42 U.S.C. 1857(h)], Section <br /> 508 of the Clean WaterAct(33 U.S.C. 1368), Executive Order 11738, and Environmental <br /> Protection Agency Regulations (40 CFR Part 15). (Contracts, subcontracts, and <br /> subgrants of amounts in excess of$100,000). <br /> ' The Contractor shall comply with mandatory standards and policies relating to energy <br /> efficiency that are contained in the state energy conservation plan issued in compliance <br /> with the Energy Policy and Conservation Act (Pub. L. 94-163). <br /> ' The City advises all general contractors and subcontractors that numerous Federal, <br /> State, and Local regulations exist that could affect the procedures used in the completion <br /> of this project. The City advises each prospective Contractor that they are responsible <br /> ' to be aware of and comply with all applicable statutes and regulations. It is <br /> recommended that each Contractor contact the local office of the following agencies for <br /> a list of applicable regulations and requirements that might affect the implementation of <br /> this project: <br /> • Federal Environmental Protection Agency <br /> • Washington Department of Health <br /> • Washington Department of Ecology <br /> • Washington Department of Fisheries <br /> Watermain Replacement"U" Division 1 —GENERAL REQUIREMENTS October 1, 2019 <br /> ' WO No—UP3698 SP—75 <br />
