7 <br /> AMENDMENT NO.1 TO PROFESSIONAL SERVICES AGREEMENT BETWEEN <br /> THE CITY OF EVERETT <br /> AND <br /> CG ENGINEERING INC. <br /> The City and CG Engineering Inc. agree to amend and modify their professional services <br /> agreement dated April 5, 2012(the"Agreement")as follows: <br /> WHEREAS, CG Engineering Inc.and the City entered into an Agreement dated April 5, 2012 <br /> ("Agreement")to provide structural engineering services,design drawings, and specifications to <br /> provide access ways into existing stormwater facilities; and <br /> WHEREAS,work is not yet complete on the access ways into existing stormwater facilities for <br /> which CG Engineering has provided structural engineering services; and <br /> WHEREAS,the Agreement is likely to expire prior to the completion of the project services to • <br /> be provided by CG Engineering Inc.and the parties expect the work to be completed by <br /> December 31, 2014; and <br /> WHEREAS,the City and CG Engineering Inc.agree to amend their Agreement to extend the <br /> time for completion from December 31,2013 to December 31,2014; <br /> NOW THEREFORE, the City of Everett and CG Engineering Inc. agree to amend and modify <br /> the Agreement as follows: <br /> 1. Section 3 of the Agreement is modified to read as follows: <br /> Time of Beginning and Completion of Performance: This Agreement shall <br /> commence as of the date of execution of this Agreement and shall be completed <br /> by December 31, 2014. <br /> 2. Regardless of the date(s) on which this Amendment is signed by the parties, the parties <br /> agree that the Agreement has been continuously in effect since April 5,2012. <br /> 3.
