= 2 <br /> v t GC/CM Contract <br /> General Contractor/Construction Manager Services for <br /> v :F; Water Pollution Control Facility Expansion <br /> Phase Cl (Liquid Stream) <br /> 5.3. Substantial Completion: All Work required by the Contract Documents shall <br /> be substantially complete within 180 calendar days of the date specified in the <br /> Notice to Proceed to begin Work. Final Completion shall be accomplished <br /> within 90 calendar days of Substantial Completion. <br /> 5.4. Substantial Completion Liquidated Damages: The parties agree that the <br /> Owner will be damaged in the event of completion delays that are the <br /> responsibility of GC/CM, and that the amount of these damages may be <br /> difficult to quantify due to the nature of this project. For failure to achieve <br /> Substantial Completion by the time specified for Work in Section 5.3 herein, <br /> GC/CM shall pay Owner $2,500 per day in liquidated damages and not as a <br /> penalty for each and every calendar day from the date when Substantial <br /> Completion should have been achieved to the date Substantial Completion is <br /> actually achieved. Assessment of liquidated damages does not substitute for <br /> or preclude recovery by the Owner of actual damages arising from a breach <br /> of GC/CM's obligations. <br /> ARTICLE 6 COMPONENTS OF TOTAL CONTRACT COST <br /> 6.1. Total for Subcontract Costs ► <br /> 6.1.1. Documentation. A Phase Cl Total Contract Cost Summary is included <br /> in the Contract as Attachment 2, dated December 2013. A complete <br /> and detailed cost breakdown for Total for Subcontract Costs is <br /> included in the Contract as Attachment 3, dated December 2013. <br /> 6.1.2. In no event will the Owner be required to pay GC/CM from the Total for <br /> Subcontract Costs for any costs incurred due to the following <br /> conditions: <br /> 6.1.2.1 Fines, penalties or other costs for re-inspection related to <br /> enforcement or compliance actions by any regulatory <br /> agency, including but not limited to the Washington State <br /> Department of Ecology.
