7 <br /> GC/CM Contract <br /> General Contractor/Construction Manager Services for <br /> Water Pollution Control Facility Expansion <br /> Phase Cl (Liquid Stream) <br /> including but not limited to, the correction of defective Work, <br /> disposal of materials or equipment wrongly supplied, and <br /> making good any damage to property, including trade <br /> damage (damage by a subcontractor to the work or <br /> property). <br /> 6.2. Risk Contingency Account <br /> 6.2.1. Risk Contingency Account: A Risk Contingency Account has been <br /> established in the amount of 2.5% of the Total for Subcontract Costs, <br /> as specified on page 1 of this GC/CM Contract. <br /> 6.2.2. Subject to prior written consent of the Owner, the GC/CM may utilize <br /> the Risk Contingency Account to pay for coordination of the following <br /> items for which it is responsible: <br /> 6.2.2.1 All costs related to Subcontractor claims or charges that <br /> result from mistakes or omissions in the subcontract buyout <br /> 6.2.2.2 Coordination errors and coordination omissions related to <br /> the shop drawings and submittals defined in the Contract <br /> Documents <br /> 6.2.2.3 Delays or interference caused by a Subcontractor impacting <br /> the construction schedule or the GC/CM's management of <br /> the project <br /> 6.2.2.4 Delays or interference caused by Subcontractor impacting <br /> the schedule or work of another Subcontractor <br /> 6.2.3. The GC/CM may not use the Risk Contingency-Account for items that <br /> are covered by the Percent Fee or defined as part of the Fixed Amount <br /> for Specified General Conditions in Sections 6.4 and 6.5 herein. The <br /> Risk Contingency Account may also not be used for Subcontract Bid <br /> Packages that.exceed the bid estimate, defective or nonconforming <br /> Subcontractor work, and/or trade damage. <br /> 6.2.4. The GC/CM's use of the Risk Contingency Account is limited to the <br /> items described in Article 6.2.2 and must be approved in writing in <br /> advance by the Owner, provided that in the event of a critical or <br /> emergency type of situation, the GC/CM determines that there is not <br /> time to obtain the Owner's written and prior approval, the GC/CM may <br /> take action at its risk that must be subsequently concurred with in <br /> City of Everett Page 13 of 25 December, 2013 <br /> Water Pollution Control Facility Expansion 28 <br />
