1 <br /> • <br /> WHEREAS,the City Council concludes the following: <br /> • <br /> 1. The City,the property owner, and the neighborhood have conducted a robust public <br /> participation process, and the plan proposed by Taylor Development responds to many of <br /> the comments and suggestions raised by neighbors through the planning process. <br /> 2. Development with approximately 100 townhomes will increase opportunities for home <br /> - ownership in a community that has seen primarily rental housing development in the <br /> immediate area over the past 25 years. <br /> 3. There is not sufficient demand for retail use other than auto-oriented type of commercial <br /> use in the general area. Owner occupied attached housing will provide an attractive <br /> option that the property owner believes will be successful for the property. <br /> 4. The planning process considered all of the elements of the work plan identified by <br /> Ordinance No. 3314-13. <br /> 5. The proposed land use plan is consistent with the Everett Comprehensive Plan. <br /> 6. No changes to existing comprehensive plan policies or development standards are . <br /> required in order to implement the land use plan for the subject property. <br /> 7. The proposed land use plan for the property will be implemented through the shoreline <br /> permit process. <br /> 8. The proposed land use plan promotes the best long term interests of the Everett <br /> community. <br /> NOW,THEREFORE,THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. The requirements of this Ordinance shall apply exclusively to the property identified <br /> in the attached Exhibit A. <br /> Section 2. The conceptual land use plan for the subject property, attached hereto as Exhibit B,is <br /> hereby approved subject to the following conditions: <br /> • a. The land use plan shall to be implemented through the City's shoreline permit <br /> process. <br /> b. The design of the exterior of the buildings on the subject property shall substantially <br /> conform to the building elevation attached hereto as Exhibit C. <br /> c. The future development and use of the subject property shall comply with the <br /> conditions of the shoreline permit. <br /> d. Any proposed changes in design,use or the type of development shall be reviewed by <br /> the Planning Commission and are subject to approval by the City Council. <br /> Section 3: The interim regulation established by Ordinance No. 3314-13, as amended, is hereby <br /> be repealed. <br /> Section 4. Severability. Should any section,paragraph, clause or phrase of this Ordinance, <br /> or its application to any person or circumstance,be declared unconstitutional or otherwise invalid <br /> 4 <br /> 5 <br />
