D. In the Parks Department,Recreation Leaders,Recreation Supervisors,Ranger Supervisors,Park <br /> Rangers,and Office Assistants may be assigned flexible shift work which includes work days and <br /> work weeks that are in excess of the normally assigned work shift or work week. <br /> The normal work week for Recreation Leaders,Recreation Supervisors,Ranger Supervisors and <br /> Park Rangers shall be forty(40)hours of work per week. The Park and Recreation Director or <br /> his/her designee shall determine the appropriate work shifts,specifying starting times and when <br /> possible,ending times. Provided that this sub-section shall not be construed to limit the <br /> department's flexibility in operating special events. <br /> E. In the Parks Department,Recreation Leaders,Recreation Supervisors,Park Rangers,Ranger <br /> Supervisors,and Office Assistants may request and when requested,the City will agree to grant <br /> "compensatory"time in lieu of wages for overtime worked. Recreation Leaders,Recreation <br /> Supervisors,Park Rangers and Ranger Supervisors shall accrue overtime or"compensatory"time <br /> at the rate of one-and-one-half times the time actually worked in excess of ten(10)hours in an <br /> assigned shift or forty(40)hours in a work week. The employee shall be allowed compensatory <br /> time for time worked in excess of ten(10)hours in an assigned shift or forty(40)hours in a work <br /> week,but not both. Use of compensatory time shall be subject to the approval of the Department <br /> Head. <br /> Mandatory court appearances when scheduled outside the employee's work schedule will be <br /> compensated at an overtime rate. <br /> Section 3: Overtime <br /> It is recognized by the parties that due to the necessity of the job requirements,overtime may be required <br /> by the Department Director or designee. <br /> All overtime must be pre-approved by the Department Director or designee. <br /> Time-and-one-half of the employee's regular hourly rate shall be paid for: <br /> A. All work performed in excess of the regularly assigned shift for full-time employees. <br /> B. All work performed in excess of a regularly assigned work week for full-time employees. <br /> C. The minimum break in service between two(2)work shifts of five(5)or more hours shall be <br /> eight(8)hours. An employee may not be required to report back to work until an eight(8)hour <br /> break in service has occurred. To compensate the employee during the break in service,time that <br /> falls within the next shift that is not worked(to provide an eight(8)hour break in service)will be <br /> paid at regular time. The end of the employee's shift will remain that of his/her regular day. If <br /> the City requires the employee to report before an eight(8)hour gap has occurred,the period of <br /> time which would have allowed an eight(8)hour gap will be paid at overtime. For example,an <br /> employee who only received five(5)consecutive hours of break in service would be paid <br /> overtime for three(3)hours during the following shift,if an eight(8)hour break has not occurred. <br /> Provided,that in no circumstance will an employee receive more than 1-1/2 times the regular <br /> salary. Provided that, in accordance with 29 CFR§ 785.22 both parties agree to exclude eight(8) <br /> hours of each twenty-four(24)hour period for Parks personnel who are assigned to participate in <br /> overnight recreational outings. <br /> 18 <br />
