fp/411K,2\;.(4., Amendment No. 1 to GC/CM Contract General Contractor/Construction Manager Services for Water Pollution Control Facility Expansion , Phase Cl (Liquid Stream) AMENDMENT NO. 1 TO GENERAL CONTRACTORJCONSTRUCTION MANAGER (GC/CM) CONTRACT BETWEEN THE CITY OF EVERETT AND IMCO GENERAL CONSTRUCTION, INC. This Amendment No. 1 is made and entered into by and between the City of Everett ("Owner") and IMCO General Construction, Inc. ("GC/CM"). This Amendment shall be effective on the last date set forth on the signature page. RECITALS A. GC/CM was selected pursuant to Chapter 39.10 RCW to expand the Owner's Water Pollution Control Facility. Because of scheduling requirements, a small portion of the project related to concrete piles needed to start in early 2014, prior to the completion of the parties' MACC negotiations on the overall project. Accordingly, GC/CM and the City entered into a GC/CM Contract dated February 24, 2014 (the "Contract") for the concrete pile work, with the intent of completing negotiations for the entire project in the meantime. Those negotiations are now complete, and Owner and GC/CM desire to amend the GC/CM Contract so that the GC/CM Contract includes the entire project. B. This Amendment No. 1 is the document that changes the GC/CM Contract from a concrete pile contract to a contract for the entire project.
