WHEREAS, ECC has applied for an Institutional Overlay Zone with the submittal of a master plan that integrates the expansion area east of the current campus with the existing campus, including a new Instructional Technology Center,the addition of approximately 245 off-street parking spaces, removal of portable classroom buildings, expansion of the Nippon Business Institute, landscaping improvements, relocation of principal vehicular access, and the construction of pedestrian and transit access improvements; and WHEREAS, the proposed master plan and Institutional Overlay Zone have undergone a thorough public review process with the surrounding neighborhood,the Planning Commission and the City Council; and WHEREAS, the Planning Commission has recommended that the City Council approve the Institutional Overlay Zone and master plan for the expansion and development of the ECC main campus; and WHEREAS, the City Council finds that the proposed rezone and development authorized pursuant to the master plan for the ECC: 1. are consistent with the Land Use Element policies for ECC and the Land Use Map designation; 2. provide for the public health, safety and welfare; and 3. promote the best long term interests of the Everett community. NOW, THEREFORE, , THE CITY OF EVERETT DOES ORDAIN: Section 1. The ECC main campus, the legal description for which is: Beginning at the northwest corner of Block 163 of the Plat of Swalwell's Fourth Addition according to the plat thereof as recorded in Volume 7 of Plats, Page 44, records of Snohomish County, Washington; THENCE north 00 degrees 16'20" west on an assumed bearing along the northerly prolongation of the west margin of said Block 163, 284.68 feet; THENCE north 67 degrees 26'26"west, 416.74 feet; THENCE, south 89 degrees 48'40"west, 439.81 feet to the northeast corner of Lot 3 of the Plat of First Addition to Legion Park according to the plat thereof as recorded in Volume 12 of Plats, Page 123, Records of Snohomish County, Washington; THENCE continuing south 89 degrees 48'40"west, along the north line of said Lot 3, 206.87 feet to the east margin of Wetmore Avenue; THENCE, south 00 degrees 10'38" east, along said margin, 790.69 feet to a point on said margin being 6.39 feet north of the southwest corner of Lot 5, Block 177 of said plat of Swalwell's Fourth Addition, said point also being on the westerly projection of an existing chain link fence; THENCE, north 88 degrees 08'59" east, generally along said chain link fence, 344.46 feet to the west margin of
