WHEREAS, ECC has applied for an Institutional Overlay Zone with the submittal of a master <br /> plan that integrates the expansion area east of the current campus with the existing campus, <br /> including a new Instructional Technology Center,the addition of approximately 245 off-street <br /> parking spaces, removal of portable classroom buildings, expansion of the Nippon Business <br /> Institute, landscaping improvements, relocation of principal vehicular access, and the <br /> construction of pedestrian and transit access improvements; and <br /> WHEREAS, the proposed master plan and Institutional Overlay Zone have undergone a <br /> thorough public review process with the surrounding neighborhood,the Planning Commission <br /> and the City Council; and <br /> WHEREAS, the Planning Commission has recommended that the City Council approve the <br /> Institutional Overlay Zone and master plan for the expansion and development of the ECC main <br /> campus; and <br /> WHEREAS, the City Council finds that the proposed rezone and development authorized <br /> pursuant to the master plan for the ECC: <br /> 1. are consistent with the Land Use Element policies for ECC and the Land Use Map <br /> designation; <br /> 2. provide for the public health, safety and welfare; and <br /> 3. promote the best long term interests of the Everett community. <br /> NOW, THEREFORE, , THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. The ECC main campus, the legal description for which is: <br /> Beginning at the northwest corner of Block 163 of the Plat of Swalwell's Fourth <br /> Addition according to the plat thereof as recorded in Volume 7 of Plats, Page 44, <br /> records of Snohomish County, Washington; THENCE north 00 degrees 16'20" <br /> west on an assumed bearing along the northerly prolongation of the west margin <br /> of said Block 163, 284.68 feet; THENCE north 67 degrees 26'26"west, 416.74 <br /> feet; THENCE, south 89 degrees 48'40"west, 439.81 feet to the northeast corner <br /> of Lot 3 of the Plat of First Addition to Legion Park according to the plat thereof <br /> as recorded in Volume 12 of Plats, Page 123, Records of Snohomish County, <br /> Washington; THENCE continuing south 89 degrees 48'40"west, along the north <br /> line of said Lot 3, 206.87 feet to the east margin of Wetmore Avenue; THENCE, <br /> south 00 degrees 10'38" east, along said margin, 790.69 feet to a point on said <br /> margin being 6.39 feet north of the southwest corner of Lot 5, Block 177 of said <br /> plat of Swalwell's Fourth Addition, said point also being on the westerly <br /> projection of an existing chain link fence; THENCE, north 88 degrees 08'59" <br /> east, generally along said chain link fence, 344.46 feet to the west margin of <br />
