• <br /> H. Street Frontage Improvements. Transportation Demand Management. Transit Station <br /> Siting Study. The street frontage requirements,transportation demand management(TDM), and <br /> the transit station siting study requirements contained in the MDNS (SEPA#12-97 dated May <br /> 23, 1997) shall apply as if fully set forth herein. <br /> I. SEPA Mitigation Measures and Other City Requirements. All mitigation measures and <br /> other conditions listed under"Information for Developer" as stated in the MDNS (SEPA#12-97 <br /> dated May 23, 1997)for the college expansion, and all other applicable City development <br /> standards and construction requirements not already stated herein shall apply as if fully set forth <br /> herein. However, in the event there is a conflict between the specific requirements set forth <br /> herein and the requirements of any other City regulations,the requirements herein shall apply. <br /> J. Signs. One freestanding sign meeting the requirements of Sign Category D shall be <br /> permitted at each vehicular access drive. The location of such signs shall be approved by the <br /> Planning Department, and may be located within the building setback areas in Paragraph C or, if <br /> approved by the City Engineer, within public right-of-way if necessary to efficiently direct traffic <br /> to off-street parking areas. <br /> K. Para-transit Vehicles. Loading/unloading zones for para-transit vehicles shall be <br /> provided as required by the City Traffic Engineer. <br /> L. Pedestrian Circulation. The on-site pedestrian circulation improvements intended for use <br /> by Whittier Elementary School students between Broadway and the elementary school shall be <br /> approved by the City Traffic Engineer. <br /> M. Whittier Elementary School. ECC shall provide evidence in a form acceptable to the City <br /> Attorney that an agreement has been reached with the Everett School District concerning the use <br /> of property owned by the Everett School District for access, and for the use of property owned by <br /> ECC for off-street parking by Whittier Elementary School. <br /> N. On-street parking by ECC students and staff. ECC shall continue to work with the City <br /> to address on street parking and traffic safety issues which currently exist or may arise from <br /> college students and/or staff parking in adjacent neighborhoods. <br /> O. Fire Code. Building Code,Utility Standards. All buildings, structures, utility systems <br /> and construction activities shall comply with the City of Everett requirements in effect at the <br /> time of permit application unless the City otherwise provides. <br /> Section 3. Should any section, subsection,paragraph, sentence clause or phrase set forth in this <br /> ordinance or its application to any person or situation be declared unconstitutional or invalid for <br /> any reason, such decision shall not affect the validity of the remaining portions of this ordinance <br /> or its application to any other person or situation. The City Council of the City of Everett <br /> hereby declares that it would have adopted this ordinance and each section, subsection, sentence, <br /> clause,phrase or portion thereof irrespective of the fact that any one or more sections, <br /> subsections, sentences, clauses, phrases or portions be declared invalid or unconstitutional. <br />
