1 ? <br /> not be unreasonably withheld, conditioned or delayed, Lessee is authorized to <br /> prepare, maintain, improve and alter the Watertank Sites for Lessee's business <br /> operations, including installation of transmission lines, connecting antennas to the <br /> transmitters and receivers. <br /> Lessee agrees that in the event there is any interference with Lessor's transmitters <br /> and/or receivers or in the event there is any interference with the transmitters <br /> and/or receivers of lessees established at the Watertank Sites prior to the date of <br /> the Lease, caused by Lessee's transmitter(s) and/or receiver(s), which is not <br /> remedied by Lessee. within seventy-two (72) hours of verbal notification by <br /> Lessor, Lessee agrees to cease using the equipment which is creating the <br /> interference (except for short tests necessary for the elimination of the <br /> interference)until the interference is eliminated. <br /> During the term of the Lease, Lessor shall maintain the condition of Lessor's <br /> existing access to and from the Watertank Sites in the condition that it existed at <br /> the commencement of the Lease. <br /> 4. Section 4 RENT: of the Lease,.(as amended by the First Addendum), is hereby <br /> deleted in its entirety and the following is inserted in its place: <br /> 4. RENT. Effective January 1, 2014, the total monthly rent for the Watertank <br /> Sites shall be Three Thousand Three Hundred Fifty Two and 27/100 Dollars <br /> ($3,352.27) per month. Commencing on January 1, 2015, and on the anniversary <br /> of that date each year thereafter (the "Adjustment Date"), the monthly rent shall <br /> increase based on the Consumer Price Index published by the Bureau of Labor <br /> and Statistics of the United States Department of Labor for all Urban Wage <br /> Earners and Clerical Workers for the Seattle-Tacoma, Washington area("CPI-U") <br /> indicator and shall be determined by dividing the CPI-U indicator,published three <br /> (3)months prior to the Adjustment Date,by the CPI-U indicator published one(1) <br /> year and three (3) monthsprior to the Adjustment Date, and multiplying the <br /> resultant number by the monthly lease rental amount of the most recent rent. In <br /> no event shall the increase in rent calculated for any one (1) year period be less <br /> than three percent(3%)or exceed five percent(5%)of the most recent rent rate. <br /> Such rent shall be paid as and when due to Lessor, as designated in Section 33 of <br /> this Lease, or at such other address which the Lessor designates by written notice <br /> to Lessee. <br /> Rent shall not include electricity. Lessee shall have a separate meter to measure <br /> Lessee's electric consumption and Lessee shall pay directly to the public utility <br /> company for any electricity used by Lessee's equipment. <br /> 5.
