6 <br /> DRAFT <br /> EMERGENCY RESPONSE AND RECOVERY DRAFT <br /> MUTUAL ASSISTANCE AGREEMENT <br /> THIS AGREEMENT is entered by and between Snohomish County,hereafter referred to as"Requesting <br /> Jurisdiction"and ,hereafter referred to as the"Responding Jurisdiction". <br /> WHEREAS,RCW 38.56.020,Intrastate Mutual Aid System,was established to provide for mutual assistance <br /> in an emergency among political subdivisions and federally recognized Indian tribes; and <br /> WHEREAS,the Requesting Jurisdiction has experienced a devastating catastrophic event requiring immediate <br /> response and recovery efforts;and <br /> WHEREAS,the Requesting Jurisdiction and Responding Jurisdiction are member jurisdictions of the Intrastate <br /> Mutual Aid System;and <br /> WHEREAS,mutual assistance has been requested by the Requesting Jurisdiction from the Responding <br /> Jurisdiction. <br /> BILLING AND PAYMENT:The Responding Jurisdiction will maintain a record of costs of mutual assistance <br /> provided and submit timely invoice(s)for rehnbursement. The Requesting Jurisdiction shall promptly <br /> reimburse the Responding Jurisdiction for all response and recovery expenses incurred. Such expenses must be <br /> properly ascertained,accumulated and reported to the Requesting Jurisdiction. . <br /> TRANSFER/ASSIGNMENT: Neither party shall have the right to transfer or assign,in whole or part,any or <br /> all of its obligations and rights hereunder without the prior written consent of the other party. When executed, <br /> this agreement shall be binding upon and shall inure to the benefit of the parities and their successors in interest. <br /> TERM OF AGREEMENT: This agreement shall be in force upon signature of both parties. If either party <br /> desires to terminate the relationship created by this agreement,then they must provide not Iess than ninety(90) <br /> days written notice to the other party. <br /> RELEASE AND HOLD HARMLESS: The Responding Jurisdiction agrees to release and hold harmless the <br /> Requesting Jurisdiction from any and all injuries,illness or losses which an individual may suffer as a result of <br /> serving in the above capacity. <br /> COMMAND,CONTROL AND COORDINATION:The Responding Jurisdiction shall exercise direct <br /> supervisory authority over assigned individuals providing mutual assistance. <br /> APPROVED AS TO FORM: APPROVED AS TO FORM: <br /> Signature Date Signature Date <br /> Signature Date Snohomish County Signature Date <br /> 24 <br />
