_ __ .
Criterion No. 2:
That the variance will not be materially detrimental to ttie property in ihe
area of the subject property or to the City as a whole.
a, Findincts:. The propasal is to install a new 7.5' x 9.5' pote
sign, which will be 23 feet in height. The sign wiil serve to
identify the building as well as products sold on site. The
applicant has stated that since lhere is a large unimproved
right of way in front of tlie subject site, the sign will sit back a
minimum of 20 feet from Evergreen N/ay.
The City provided written notice to sll property owners within
300 feet of the subject property; at itie time the staff report
was completed, no comments had been received.
The City of Everett Public Worl<s and Buiiding Departments
had the opportunity to review the pr000sal. The followig
comments were provided: A building aennit is required. An
electrir,al permit is required if the sign is to be lighted. Also,
Public Works has statei that since a 30"weter main is in the
viciniry of the pole sign the e^plicant shall provide a minimum
10-foot separation from lhe FIe to the main for maintenance
purposes.
b. Conclusions: Since the sign ill be located farther off of ihe
Evergreen Way frontage lhan a majority of signs in the area,
the sign shouid have minimal irnpact Qn neiyhboring
properties. The proposed variance shoufd not be materially
detrimental to the neighborhood area or the City as a whole.
Criterion No. 3:
That the variance will only grant the subject property the same general
rights enjoyed by other property in the same area and zone as the subject
properry.
a, Findin s: In 1969 the City of Everett issued a building permit
for the placement of a pole sign on the subject site. Howeve,r
the sign was IikQly located in City right-of-way and has
subsequently been removed. There are several
noncor.forming sicns immediately adjacerit to the site. These
include signs whic;h are over height, exceed sign area, ar fail
to meet required setbacks. By allowing the new sign to be
erected on site the applicant is enjoyir the same rights of
neighboring properties nd businesses, by allowing
themselves som form of public advertising.
Evergreen Way is host to aumerous businesses that have
freestanding signs. Many of these signs do not meet the
current zoning setback requirements.
3
