3 <br /> STATE OF WASHINGTON <br /> DEPARTMENT OF NATURAL RESOURCES <br /> PETER GOLDMARK,Commissioner of Public Lands <br /> ROAD USE PERMIT <br /> Permit No.50-091200 <br /> THIS PERMIT,made and entered into this day of ,2014, <br /> by and between the State of Washington, acting by and through the Department of Natural <br /> Resources,herein called the "Grantor" and CITY OF EVERETT, a political subdivision of the <br /> State of Washington,herein called the "Grantee." <br /> Conveyance. Grantor, for and in consideration of the terms and conditions specified herein, <br /> hereby grants and conveys to the Grantee,for the purpose of administrative access, road <br /> construction,road abandonment,timber haul,rock haul,reforestation, and plantation <br /> maintenance access, a nonexclusive permit to use a road over and across a strip of land, <br /> hereinafter defined as the "premises," in the S1/2 NW1/4,N1/2 S1/2 of Section 1,NE1/4, S1/2 <br /> NW1/4 of Section 2, and the E1/2 NE1/4 of Section 3, all in Township 28 North,Range 7 East, <br /> W.M.;Nl/2 SE1/4 SE1/4 of Section 5, W1/2 SW1/4, SE1/4 SW1/4 of Section 6,NW1/4 NE1/4, <br /> S1/2 NE1/4,NE1/4 NW1/4 of Section 7, W1/2 NE1/4 of Section 8 and the NW1/4 NE1/4 of <br /> Section 17,all in Township 28 North,Range 8 East,W.M., in Snohomish County, State of <br /> Washington. The location of said premises located approximately as shown on Exhibit A-1 and <br /> A-2,attached hereto. Said premises shall be confined to such widths as indicated on Exhibit A-1 <br /> and A-2. The word premises when used herein means a strip of land whether or not there is an <br /> existing road located thereon. The word "road" shall mean roads now existing or hereafter <br /> constructed on the premises, or any segment of such road. <br /> In addition, Grantor hereby conveys to Grantee timber currently growing within the Permit Area <br /> as set forth in Exhibit D, and authorizes the removal of such timber as necessary to construct or <br /> reconstruct road. Any timber conveyed under this Permit that is not removed within five(5) <br /> years from the date of this Permit or the date of authorization by State,whichever is later, shall <br /> be deemed forfeited and become the property of State. <br /> The permit is subject to the terms and conditions hereinafter set out. <br /> Consideration.
