"Alley" means the minor portian of the public <br />road networknot designed for general trav�l and used <br />pr:mazily as means of access to the rear of residences <br />and business establishments. <br />B. "Alley improvement" means the drainage, grad- <br />ing and pavement facilities rcquired to improve the <br />alley to city design standards. <br />C. "City engineer" means the person appointeu by <br />the mayor to posi[ion of engineering depamnent head, <br />or his dcsignee. <br />D. "Right-of-way" means the public property used <br />or reserved formunicipal pucposes including all public <br />utilitles and sheet usages. <br />E. "Street" means a11 or any portion of the city <br />public road network open to the public for uavel with <br />exception of alleys and limited acress highways desig- <br />nated as State Highways. <br />F. "Street improvements" means the installation of <br />all public facilities required ro improve the street to city <br />design standards including grading, drainage, pave- <br />ment, curb/gutter, sidewall;, street lights, haf5c signals <br />and other necessary appurtenances. Such street im- <br />provements shall not be limitcd to the half street abut- <br />ting the property; for example, where no permanent <br />street improvement ezisted, the street improvement <br />shall be extended beyond the ccnterline a suf5cient <br />distance (ten feet minimum} to permit safe movement <br />of traf5c. <br />G. "Interim street imprwemenu" meaas the in- <br />stallation o: improvements to bring the public facility <br />up ro the eAsting character of the surrounding streeu <br />aad pedestrian facilities and may include widr,ning of <br />or insWlladon of the asphalt street surfacc, gravet <br />478 <br />`. (Ord. 665- <br />80 § 1,1980: Ord. 555-78 § 1,1978) <br />13.68.020 Applleabllity. <br />No building permit shall be issued by the ciry for <br />construction of any new building or facility oF any kind <br />or description, or in connection with any additions, <br />alterations, or repairs within any twelve-month period <br />which ezceeds fifty percent of the current market value <br />of an eAsting building or facility on the property, unless <br />or undl the public streets and alleys upon which the <br />same abuts shall be improved at the owner(s) expense <br />in accordance with the following requirements: <br />A. All business, commetcial, industrial, and multi- <br />ple-family residential (frve uniu or more) lar.d uses, <br />shall be required to consavet street and/or alley im- <br />provements together with all necessary appurtenances; <br />provided, that if in the discretion of the city engineer <br />any of the following conditions are found to exist, the <br />city engineer may allow the property owner to Provide <br />interim improvemenu as deEuied in subsection C of <br />Section 13.68A10, or to deviate from the requirements <br />of Uils chapter: <br />1. Where a propased development is subjec[ to the <br />environmental review process pursuant to the State <br />Environmental Policy AM (SEPA) and Ordinance No. <br />582-79 as amended, and conditions have been imposed <br />tttrough the environmental review process which are <br />intended to alrer, supplement or replace the requ'ue- <br />ments of this chapter, <br />2. Where a proposed deve]opment is detecmined to <br />be cxempt &om the requirements of the State Environ- <br />ment Policy Act and Ordinance No. 582-79 as <br />amended, and where the ciry engineer determines that <br />ultimate improvemcnts are not desirable at the presen[ <br />time due to eAsting severe horizontal or severe vertical <br />grade alie,�unent problcros; <br />3. Wherethecityengineerissatis5edthatadequatc <br />improvements eAst except fornominal lacking of street <br />width; <br />4. Where plans for more compreheasive improve- <br />menu eAst which would alter the ultimate improve- <br />ments required to be constrvcted on the public right- <br />of-way abutting the proposed devclopment site. <br />In every case where interim improvements are al- <br />lowed, the property owner is requ'sed to provide a <br />recorded covenant power of attorney to the city (here- <br />inafter refersed to as "LID covenant") in support of a <br />petition local improvement district for construction of <br />street and alley improvemencs, rogether with all neces- <br />
