The <br />property is a commercial building which houses Sporty's Beef and Brew, a restaurant and <br />tavern. In October, 1989, the Appellant received a building permit from the City of Everett <br />to remodel the building on-site. No street improvements were required at that time <br />because the City determined that the improvements were less than 50% of the value of the <br />existing building. The remodel was completed. In August, 1992, the Appellant made an <br />application for an addition to the building. At that time the City Public Works Department <br />informed the Appellant that street improvements were required even though the projected <br />1g92 improvements were less than 50% of the value of the su6ject properly. The <br />Appellant has appealed the City's decision requiring street improvements. <br />A hearing on the appeal was held before the Hearing Examiner of the City of Everett on <br />November 12, 1992.
