Council provided that the Ordinance would expire June 30, 2014, unless earlier renewed by
Council, so that the issue would come before Council prior to that date. The State Legislature has not yet
taken action to harmonize the recreational marijuana and medical marijuana statutes. When the State
Legislature takes action, reconsideration of the City's approach would be warranted. However, the
uncertainty justifying the approach taken in Ordinance No. 3309-12 still exists and makes it difficult for the
City to vary its approach. Additionally, the City has not experienced any problems under the current
approach and doesn't believe that it will if Ordinance No. 3309-12 is extended.
RECOMMENDATION (Exact action requested of Council): Adopt the Ordinance related to cannabis
nuisances, amending Ordinance No. 3309-12.
