ORDINANCE NO. <br /> AN ORDINANCE Related to Vehicle Impounds, <br /> Amending Ordinance No. 993-83, as amended (EMC 46.10.010). <br /> Whereas, in certain circumstances unlawfully parked vehicles with four or <br /> more parking infractions are subject to impoundment pursuant to EMC <br /> 46.10.010.A.9; and <br /> Whereas, impounding a vehicle in these circumstances deters future <br /> parking violations, pushes the vehicle owner to pay their parking infraction fees, <br /> and promotes parking management in the City; and <br /> Whereas, the City Council finds that amending Chapter 46.19 EMC to <br /> require that parking infractions for which the registered owner has failed to <br /> respond, appear, or pay be paid in full prior to redeeming a vehicle when it is <br /> impounded pursuant to EMC 46.10.010.A.9 is appropriate to deter parking <br /> infractions, collect unpaid fees, and encourage good parking management; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. Section 1 of Ordinance No. 993-83, as amended by Section 1 of <br /> Ordinance No. 1068-84, as amended by Section 1 of Ordinance No. 1531-88, as <br /> amended by Section 1 of Ordinance No. 2396-99, as amended by Section 1 of <br /> Ordinance No. 3028-07 (EMC 46.10.010), which reads as follows: <br /> Officers authorized to remove certain vehicles. <br /> A. Impoundments. Whenever the driver of a vehicle is arrested for a violation <br /> of RCW 46.61.502 or 46.61.504, the vehicle is subject to impoundment at <br /> the direction of a law enforcement officer. In addition, a police officer or <br /> parking enforcement officer may take custody of a vehicle and provide for <br /> its prompt removal to a place of safety under any of the following <br /> circumstances: <br /> 1. Whenever any police officer or parking enforcement officer finds a <br /> vehicle stopped or parked upon any roadway or alley, whether <br /> attended or unattended, the officer is authorized to provide for the <br /> removal of the vehicle or require the driver or other person in charge of <br /> 66 <br />
