6 <br />(9) <br />9. Notifying the City when Ecology's Work has been completed. <br />10. Providing documentation to the Owner of all Work performed for <br />the Property. This documentation shall be provided as part of the <br />overall clean-up notebook provided by Ecology to the Owner <br />within one (1) year of the completion of the Work, as practicable. <br />Ecology Investigation of Reported Issues <br />Ecology will use the following procedure for investigating concerns and <br />issues reported by the City during the performance period of this Owner <br />Agreement. Ecology will endeavor to provide the City a response to <br />reported issues within a week of their discovery or reporting by the City. <br />Ecology, may modify this procedure to more specifically address the <br />reported concerns and/or issues: <br />1. An Ecology representative will respond to contacts from the City <br />by the next business day after the report is communicated to <br />Ecology or Ecology's field representatives. Weekends and State <br />legal holidays will typically delay an initial response until the next <br />business day after the weekend or holiday unless the report is of a <br />nature that is deemed to be an emergency. This response may <br />involve scheduling a time to meet with the City to discuss their <br />concerns and/or scheduling a time when an Ecology field <br />representative can visit the Property and investigate the reported <br />issue. <br />2. lnfonnation on the reported issue will be obtained through a <br />condition -appropriate combination of examining the visible <br />conditions of the reported issue, discussing the condition with the <br />City, reviewing pre-existing photographs and documentation, <br />and/or reviewing construction records applicable to the condition. <br />3. The fmdings of the investigation will be communicated to <br />Ecology's Site Manager and the Everett Smelter Project Manager <br />for evaluation and review. Based on the information available, <br />Ecology will develop conclusions to respond to the investigation <br />request or determine additional investigation is necessary to more <br />completely evaluate the issue. If Ecology has deterrnined that <br />additional investigation is required, this shall not exceed 15 <br />calendar days from the date the concern was submitted to Ecology. <br />4. Ecology will communicate its investigation conclusions and <br />response to the City within 7 calendar days from the date of the <br />reported concern. <br />36 <br />
