7 <br />Rehabilitation Act of 1973 (PL 93-112), as amended (29 U.S.0 §794), which <br />prohibits discrimination on the basis of disability; (e) the Age Discrimination Act of <br />1975, as amended (42 U.S.0 §§6101 et seq.), which prohibits discrimination on the <br />basis of age; (f) Fly America Act of 1974 which states preference for U.S. Flag Air <br />Carriers, (g) Drug -Free Workplace Act of 1988 which requires the Subgrantee to <br />notify the County if an employee of the recipient is convicted of violating a criminal <br />drug statute, (h) Trafficking Victims Protection Act of 2000, (i) Animal Welfare Act of <br />1966, (j) Clean Air Act of 1970, (k) Clean Water Act of 1977, (I) National Flood <br />Insurance Act of 1968, (m) Flood Disaster Protection Act of 1973, (n) Coastal <br />Wetlands Planning, Protection, and Restoration Act of 1990, (o) USA Patriot Act of <br />2001,and (p) the Fair Housing Amendments Act of 1988 (42 U.S.C. §§3601 et <br />seq.), as amended, relating to nondiscrimination in the sale, rental or financing of <br />housing. However, the requirements of Section 202 of Executive Order 11246, as <br />amended, do not apply to a government contractor or subcontractor that is a <br />religious corporation, association, educational institution or society, with respect to <br />the employment of individuals of a particular religion to perform work connected with <br />the carrying on by such corporation, association, educational institution or society of <br />its activities. <br />b. If applicable, environmental standards prescribed pursuant to the following: (a) <br />protection and enhancement of environmental quality pursuant to Executive Order <br />(EO) 11514, as amended; (b) administration of the Clean Air Act and the Federal <br />Water Pollution Control Act with respect to Federal contracts, grants, or loans <br />pursuant to EO 11738; (c) protection of wetlands pursuant to EO 11990, as <br />amended; (d) floodplains management pursuant to EO 11988, as amended; (e) the <br />Coastal Zone Management Act of 1972 (P.L. 92-583), 16 U.S.C. §§1451 et seq., as <br />amended; (f) Air Quality & Emission Limitations pursuant to 42 U.S.C. §§7401 et <br />seq.; (g) the Safe Drinking Water Act of 1974 (PL 93-523), as amended; and, (h) the <br />Endangered Species Act of 1973 (PL 93-205), as amended. <br />11. Per 2 CFR Part 215, Subgrantees are subject to applicable regulations governing patents <br />and inventions, including government -wide regulations issued by the Department of <br />Commerce at 37 CFR part 401, "Rights to Inventions Made by Nonprofit Organizations and <br />Small Business Firms Under Government Grants, Contracts and Cooperative Agreements." <br />The Subgrantee may copyright any work that is subject to copyright and was developed, or <br />for which ownership was purchased, under an award. DHS/FEMA reserves a royalty -free, <br />nonexclusive and irrevocable right to reproduce, publish, or otherwise use the work for <br />Federal purposes, and to authorize others to do so. <br />The Federal Government has the right to: obtain, reproduce, publish or otherwise use the <br />data first produced under an award and authorize others to receive, reproduce, publish, or <br />otherwise use such data for Federal purposes. <br />All recipients of financial assistance will comply with requirements to acknowledge Federal <br />funding when issuing statements, press releases, requests for proposals, bid invitations, <br />and other documents describing projects or programs funded in whole or in part with <br />Federal funds. <br />SHSP-FFY 12 <br />Page 9 of 25 <br />48 <br />E13-152 — Everett -DEM <br />
