"Director"means public works or utilities director. <br /> 8. "Properly installed"means installed by a licensed contractor or plumber in <br /> accordance with section E or installed by the Department in accordance <br /> with section F. <br /> B. Backwater Prevention Device Requirement. <br /> 1. New Connections. Unless otherwise permitted by the Director, it is <br /> unlawful for any person to connect to the City sewer system with <br /> plumbing fixtures at an elevation below the elevation of the upstream <br /> sewer manhole rim without properly installed ABWDs sufficient to <br /> prevent sewer backups,which usually will be backwater valves at outlets. <br /> ABWDs shall be installed to facilitate future access and maintenance. <br /> Unless the Director determines that the City will maintain an ABWD,the <br /> effective operation of ABWDs shall be the responsibility of the owner of <br /> the sewer or drain. This section B.1 applies regardless of whether the <br /> structure is a Designated Structure or not. <br /> 2. Designated Structures. All Designated Structures must have properly <br /> installed and maintained ABWDs sufficient to prevent sewer backups. <br /> This applies regardless of whether the Designated Structure or its sewer <br /> connections are new or existing. <br /> C. Installation of ABWDs at Designated Structures <br /> 1. Private Installation at Designated Structures. <br /> a. The Department is authorized to offer an ABWD program to <br /> property owners to install an ABWD at their Designated Structure <br /> in accordance with.this section. This program may include <br /> reasonable rebate,reimbursement or other mechanisms as <br /> established by the Department. Unless determined otherwise by <br /> the Director on a case-by-case basis,the maximum amount of the <br /> rebate will be the same for all Designated Structures and will be <br /> based on the cost to properly install an ABWD at single family <br /> residence. The ABWD shall be installed by a licensed contractor <br /> or plumber in accordance with standards,and following an <br /> inspection protocol,established by the Director. As established by <br /> the Director,the ABWD shall be installed either outside the <br /> structure being served by the ABWD in a location that is easily <br /> accessible for inspection and maintenance,or installed within the <br /> 9 <br />
