Designated Structure, whichever location in the opinion of the <br /> Department best prevents basement flooding. For those ABWDs <br /> installed outside the Designated Structure,the Department may <br /> require the owner to provide the City a perpetual right-of-entry,on <br /> a form approved by the City attorney,allowing the City to enter <br /> the property at reasonable times to inspect and maintain the <br /> ABWD. <br /> b. A property owner's acceptance of the Department's ABWD offer <br /> shall obligate the property owner to coordinate installation of the <br /> ABWD and disconnection of all downspouts on the property <br /> consistent with City guidelines. <br /> c. The notice to each property owner from the Department of the <br /> ABWD program will be mailed to the property owner of record as <br /> of the date of mailing. The notice will be deemed received three <br /> days after mailing. The notice shall contain a prominently <br /> • displayed deadline date for installation of the ABWD at the <br /> property owner's Designated Structure. This deadline shall be no <br /> earlier than six months after the mailing of the notice. This date is <br /> defined as the"deadline date." The Director may extend the <br /> deadline date. A property owner may participate in the program <br /> after the deadline date. However, as set forth in section E,the <br /> City will not pay claims related to sewer backups after the deadline <br /> date for Designated Structures that did not have properly installed <br /> and approved ABWDs at the time the backup occurred. <br /> 2. Department Installation of ABWDs at Designated Structures. The <br /> Department,on a schedule to be determined by the Department, is <br /> authorized to cause ABWDs to be installed for Designated Structures that <br /> have not had ABWDs privately installed pursuant to section C.1. ABWDs <br /> installed pursuant to this section typically will be installed at a point in the <br /> lateral sewer that is within public right-of-way,with the specific location <br /> to be determined solely at the Department's discretion. The Director has <br /> discretion to not install ABWDs at Designated Structures when such <br /> installation is deemed by the Director to not be in the best interests of the <br /> -City,in which case the owner of Designated Structure remains responsible <br /> to install ABWDs. <br /> D. ABWD Maintenance <br /> Unless otherwise determined by Director on a case-by-case basis,the Department <br /> will inspect and maintain ABWDs installed outside a Designated Structure on a <br /> schedule to be determined by the Director.
