The ordinance is effective for one year, and was
intended to allow the City to monitor the impacts of recreational marijuana businesses before establishing
more permanent regulations. To date, the City has very limited experience with recreational marijuana
businesses. Only one business has been approved in the city and it is not yet open for business. In addition to
this limited experience, there has been litigation over other municipalities' regulation of marijuana
businesses, and there may be action in the upcoming State legislative session to merge the recreational
marijuana and medical marijuana regulations. As a result, the Planning Commission has recommended that
the City Council renew the interim regulations an additional six months, with a few changes highlighted in
the attached draft ordinance. The intent is to review progress or developments within the coming six month
period to determine if the interim regulations can be replaced with permanent regulations.
RECOMMENDATION(Exact action requested of Council): Adopt Ordinance modifying and renewing
interim zoning regulations related to recreational marijuana businesses.
5
