Police
Ordinance Nos. 1554-89 as Consent Contact Person Kevin Fagerstrom
amended and 2840-05 Action Phone Number 425-257-8565
(Chapters 8.20 and 8.60 EMC 11-5-14 First Reading FOR AGENDA OF 11-5-14
respectively) 11-12-14 Second Reading
11-19-14 Third Reading
Public Hearing
Initialed by:
Department Head
• CAA
Council President f 1
.
Location Preceding Action Attachments Department(s) Approval
Amount Budgeted -0 •
-
Expenditure Required -0- Account Number(s):
Budget Remaining -0-
Additional Required -0-
DETAILED SUMMARY STATEMENT:
The purpose of this proposed ordinance is to update chapters 8.20 and 8.60 EMC (both prohibiting certain
outdoor public nuisance conditions)to clarify the intent of the ordinances.
Chapter 8.20 limits outdoor public nuisance conditions like junk, trash, dead vegetation, and discarded items in
the yards of any property in Everett if it is visible to the public or to the neighbors. Property owners have
successfully argued that junk and other discarded items in a driveway, carport, gazebo, or the like are not subject
to the ordinance because the items are not in the"yard"of the property. The revisions to this ordinance are
meant to clarify that the outdoor public nuisance conditions listed in the ordinance are prohibited anywhere on
the outside areas of the property if they are visible to the public or neighbors. The revisions also clarify the
definition of a utility trailer.
Chapter 8.60 limits the number of vehicles that are allowed on the outside of a residential property to four to
preserve the neighborhood aesthetics and prevent a commercial look in a residential neighborhood. Certain
exemptions apply. The revisions to this ordinance limit the instances when more than four vehicles may be
allowed on a property to minimize the commercial appearance in a residential zone that the ordinance is meant
to prevent.
RECOMMENDATION (Exact action requested of Council):
Adopt an Ordinance Related to Public ;iiisances, mendincg Ordinance Nos. 1554-89 as amended and 78 -0-05
(C1i'.:'!-%'Cis 2.7)0 a1! 2.60 E\'IC L s JC_ilvC[' J
5
