To avoid incurring additional costs related to these
stands,the City will need to immediately sell these seized items. Because the City does not have access to
the stands at this time, staff can only provide an estimated value based on limited infouivation. The stands
are each estimated to be worth somewhere between$3000 to $8000 and the equipment in each stand is
estimated to be worth under$1000. This value may change as more information becomes available. But any
sale will reflect the actual value.
If the City does not immediately sell the stands,it will incur costs in one of two ways. On one hand, if the
stands remain in their current location,the City may owe rents to the landlords for the stands which could be
approximately$2500 per month per stand. On the other hand,if the City were to move the stands from their
current locations, it would cost approximately$1000 per stand or more for the moving costs.
In an effort to avoid these costs,the City is asking that Council waive the 13-day notification period
stipulated in EMC 3.88.070(b)by allowing staff to accept bids for the stands and/or negotiate a sale with
interested parties more expeditiously. EMC 3.88.070 (c) allows the Council to approve an alternate process
for the sale.
RECOMMENDATION(Exact action requested of Council):
Adopt Resolution Declaring Five Seized Coffee Stands Surplus and Authorizing Sale by Negotiated Sale
and/or Public Auction
133
