RESOLUTION No. <br /> A Resolution Declaring Five Seized Coffee Stands Surplus and <br /> Authorizing Sale by Negotiated Sale and/or Public Auction <br /> Whereas, the City has or will soon have possession of five structures currently used as coffee <br /> stands as well as the equipment in the stands; and <br /> Whereas,the stands and equipment are of no real value or use to the City; and <br /> Whereas,Ordinance 2963-06 [Chapter 3.88 EMC] establishes a procedure and method for <br /> surplusing or disposition of City-owned personal property; and <br /> Whereas,based on the guidelines set forth in[EMC 3.88.070(C)] Section 2 of Ordinance 2963- <br /> 06,the city can adopt alternate procedures for disposing of surplus property; and <br /> Whereas,the City wishes to sell the stands and equipment as soon as possible without incurring <br /> additional costs to stop the stands and equipment from being used for illegal activity and to <br /> reduce costs to the City;and <br /> Whereas,the City has been contacted by parties who are expected to make offers to purchase the <br /> stands and equipment; and <br /> Whereas,the City's Purchasing Manager has reported the basis for the estimated value of the <br /> stands and equipment and has recommended surplusing the above-referenced stands and <br /> equipment; and <br /> Whereas, staff is requesting that Council waive the 13-day notification period stipulated in EMC <br /> 3.88.070(b)by allowing staff to accept bids for the stands and equipment and/or negotiate a sale <br /> with interested parties more expeditiously; and <br /> Whereas,EMC 3.88.070 (c)allows Council to approve an alternate process for the sale; <br /> NOW,THEREFORE,it is hereby resolved by the City Council of the City of Everett: <br /> The five coffee stands as well as the associated equipment to be seized by the City are hereby <br /> declared surplus. In accordance with EMC 3.88.070(c),the Purchasing Manager is hereby <br /> authorized to sell the stands and associated equipment by negotiated sale and/or public auction. <br /> 134 <br />
