RESOLUTION No. A Resolution Declaring Five Seized Coffee Stands Surplus and Authorizing Sale by Negotiated Sale and/or Public Auction Whereas, the City has or will soon have possession of five structures currently used as coffee stands as well as the equipment in the stands; and Whereas,the stands and equipment are of no real value or use to the City; and Whereas,Ordinance 2963-06 [Chapter 3.88 EMC] establishes a procedure and method for surplusing or disposition of City-owned personal property; and Whereas,based on the guidelines set forth in[EMC 3.88.070(C)] Section 2 of Ordinance 2963- 06,the city can adopt alternate procedures for disposing of surplus property; and Whereas,the City wishes to sell the stands and equipment as soon as possible without incurring additional costs to stop the stands and equipment from being used for illegal activity and to reduce costs to the City;and Whereas,the City has been contacted by parties who are expected to make offers to purchase the stands and equipment; and Whereas,the City's Purchasing Manager has reported the basis for the estimated value of the stands and equipment and has recommended surplusing the above-referenced stands and equipment; and Whereas, staff is requesting that Council waive the 13-day notification period stipulated in EMC 3.88.070(b)by allowing staff to accept bids for the stands and equipment and/or negotiate a sale with interested parties more expeditiously; and Whereas,EMC 3.88.070 (c)allows Council to approve an alternate process for the sale; NOW,THEREFORE,it is hereby resolved by the City Council of the City of Everett: The five coffee stands as well as the associated equipment to be seized by the City are hereby declared surplus. In accordance with EMC 3.88.070(c),the Purchasing Manager is hereby authorized to sell the stands and associated equipment by negotiated sale and/or public auction. 134
