Our current <br /> information is as follows: <br /> • The damage is subsidence of the roadway due to loss of lateral support, <br /> caused by a large drainage ditch cut by the adjacent property owner. <br /> • We understand that property owner to be you or companies you control. <br /> • Contractors and equipment were observed on your property immediately <br /> east of the roadway conducting large scale site preparation work <br /> (casually estimated at more than 50 acres.) Equipment observed on site <br /> included a large tracked excavator, a large off road class dump truck and <br /> a medium dozer. <br /> • The contractors had excavated a large trench several feet deep and wide <br /> parallel to our roadway. This trench undermined the lateral support of <br /> the roadway causing the substantial roadway settlement, estimated at 6" <br /> to 12"over the period of 24 to 48 hours after the trenching activity. The <br /> trench runs about 300 feet along the edge of the roadway right of way. <br /> In addition to the roadway, the City maintains utilities within the roadway bed <br /> that includes a large regional sewer interceptor. This letter is notice that the City <br /> will seek reimbursement from you (or from the entity that owns the adjacent <br /> property, as appropriate) for all costs and losses the City incurs arising from or <br /> relating to roadway and utility damage, including without limitation all costs of <br /> repairing that damage. <br /> Finally,your contractor or employee has approached our City Engineer relating to <br /> fixing the trench and the lateral support problems While City staff may provide <br /> some ideas for consideration, the responsibility for correct design of any such fix <br /> on your property is exclusively yours, aided as appropriate by your civil and <br />
