The agreed order means the City agrees that it will not take <br /> further action against the respondent regarding the violations described in this citation as <br /> long as there are no additional nuisance-related EMC violations for the two-year period <br /> following the date of the order. If the respondent is eligible to enter into an agreed order <br /> with the City and signs the agreed order,the respondent is no longer required to appear at <br /> the hearing set forth in Paragraph 5. <br /> 7. Hearing Examiner <br /> Failure of the respondent to enter into an agreed order with the City and/or complete the <br /> minimum corrective action described in this citation means that the respondent must <br /> attend the hearing. Following the hearing,the Violations Hearings Examiner may issue <br /> an Order against the respondent, even if he/she doesn't attend the hearing. The Hearings <br /> Examiner Order may include the following conditions: <br /> a. A requirement that all violations be corrected and a deadline set for correction; <br /> b. A fine of up to $500.00 per violation for initial violators; <br /> c. A fine of up to $1,000.00 per violation for repeat violators; <br /> d. Additional costs; <br /> e.
