line. The stream flows northward through the pipe that is located near the west <br /> lot line of Lot 1. Neither the stream, nor the pipe, would be altered. The second environmental feature of the site is a steep slope located near the <br /> southwest corner of the property. The slope, approximately 45% at its greatest, <br /> rises approximately 25 feet from west to east. It is densely covered with trees, <br /> including deciduous trees and a mixture of understory vegetation. A <br /> geotechnical engineering study was done of the slope and there were no <br /> indications of instability. However, because the slope is compromised with fill, <br /> the proposed building to be developed on Lot 3 is recommended to be setback <br /> at least 10 feet from the top of the slope. As part of the environmental review of the project, a Phase I Environmental Site <br /> Assessment was prepared as part of the geotechnical engineering study. <br /> There are no hazardous substances or petroleum products that have been <br /> identified on-site. (exhibit 1, staff report, page 9; exhibit 12, geotechnical <br /> engineering study; testimony of Ms. Weldon) <br /> 25. The City submitted that based on its review, the proposed short subdivision <br /> complies with SEPA and Critical Area regulations. (exhibit 1, staff report, page <br /> 9; testimony of Ms. Weldon) <br /> 26. Storm drainage for the site is within the Pigeon Creek No. 1 Drainage Basin. <br /> CHS submitted a drainage report, issued on December 16, 2016, which was <br /> reviewed by the Everett Public Works Department. The department <br /> commented that the report and design must be updated to meet current 2017 <br /> standards. CHS will be required to review the drainage consistent with the <br /> current stormwater regulations at the time the building permit is filed. The City <br /> submitted that it is anticipated that stormwater can be managed in a manner <br /> that is consistent with the current standards. (exhibit 1, staff report, page 9; <br /> exhibit 16, page 2 (11), comments from agencies and city departments; <br /> testimony of Ms. Weldon) <br /> 27. Yard area and on-site recreation, as defined in EMC 18.28.250 and 18.28.260, <br /> usually must be satisfied for short subdivision approval. However, the City, in <br /> reviewing the instant application, determined that these ordinances are not <br /> applicable because the development on-site will not be for single-family <br /> development or a larger traditional subdivision. There will be a total of 19,264 <br /> square feet of lawn and garden area with a gazebo, garden shed and outdoor <br /> terrace area to the west of the building on Lot 3.
