(2) Notify the employer in writing of the employee's conviction for a violation of a criminal drug statute <br /> occurring in the workplace no later than five calendar days after such conviction; <br /> (e)Notifying the Department, in writing,within 10 calendar days after receiving notice under <br /> subparagraph (d)(2)from an employee or otherwise receiving actual notice of such conviction. Employers <br /> of convicted employees must provide notice, including position title of any such convicted employee to <br /> the Department, as follows: <br /> For COPS award recipients -COPS Office, 145 N Street, NE,Washington, DC, 20530; <br /> For OJP and OVW award recipients -U.S. Department of Justice, Office of Justice Programs,ATTN: <br /> Control Desk, 810 7th Street, N.W.,Washington, D.C. 20531. <br /> Notice shall include the identification number(s)of each affected award; <br /> (f)Taking one of the following actions,within 30 calendar days of receiving notice under subparagraph <br /> (d)(2),with respect to any employee who is so convicted: <br /> (1)Taking appropriate personnel action against such an employee, up to and including termination, <br /> consistent with the requirements of the Rehabilitation Act of 1973, as amended; or <br /> orily <br /> Requ pp such employee <br /> for uchpurposes participateby Federal,tStat in or local health, law enforcement, or otherprogram <br /> approved <br /> appropriate agency; and <br /> (g) Making a good faith effort to continue to maintain a drug-free workplace through implementation of <br /> paragraphs (a), (b), (c), (d), (e), and (f). <br /> 5. COORDINATION REQUIRED UNDER PUBLIC SAFETY AND COMMUNITY POLICING PROGRAMS <br /> As required by the Public Safety Partnership and Community Policing Act of 1994, at 34 U.S.C. § 10382(c) <br /> (5), if this application is for a COPS award,the Applicant certifies that there has been appropriate <br /> coordination with all agencies that may be affected by its award.Affected agencies may include, among <br /> others, Offices of the United States Attorneys; State, local, or tribal prosecutors; or correctional agencies. <br /> I acknowledge that a materially false,fictitious, or fraudulent statement(or concealment or omission of a <br /> material fact) in this certification, or in the application that it supports, may be the subject of criminal <br /> prosecution (including under 18 U.S.C. §§ 1001 and/or 1621, and/or 34 U.S.C.§§ 10271-10273), and also <br /> may subject me and the Applicant to civil penalties and administrative remedies for false claims or <br /> otherwise (including under 31 U.S.C. §§3729-3730 and 3801-3812).
