I 2 The rights exercised under the provisions of this section shall not diminish the Contracting 3 Agency's right to pursue any other avenue for additional remedy or damages with respect to 4 the Contractor's failure to perform the work as required. 15 6 7 1-05.11.RTF ' 8 1-05.11 Final Inspection 9 10 Delete this section and replace it with the following: I 11 12 1-05.11 Final Inspections and Operational Testing 13 (October 1, 2005 APWA GSP) I 14 15 1-05.11(1) Substantial Completion Date 16 When the Contractor considers the work to be substantially complete, the Contractor shall I17 18 so notify the Engineer and request the Engineer establish the Substantial Completion Date. 19 The Contractor's request shall list the specific items of work that remain to be completed in 20 order to reach physical completion. The Engineer will schedule an inspection of the work 21 with the Contractor to determine the status of completion. The Engineer may also establish 22 the Substantial Completion Date unilaterally. 23 I 24 If, after this inspection, the Engineer concurs with the Contractor that the work is 25 substantially complete and ready for its intended use, the Engineer, by written notice to the 26 Contractor, will set the Substantial Completion Date. If, after this inspection the Engineer I 27 does not consider the work substantially complete and ready for its intended use, the 28 Engineer will, by written notice, so notify the Contractor giving the reasons therefor. 29 I 30 31 Upon receipt of written notice concurring in or denying substantial completion, whichever is applicable, the Contractor shall pursue vigorously, diligently and without unauthorized 32 interruption, the work necessary to reach Substantial and Physical Completion. The 33 Contractor shall provide the Engineer with a revised schedule indicating when the I34 Contractor expects to reach substantial and physical completion of the work. 35 36 The above process shall be repeated until the Engineer establishes the Substantial 1 37 Completion Date and the Contractor considers the work physically complete and ready for 38 final inspection. 39 I 40 1-05.11(2) Final Inspection and Physical Completion Date 41 42 When the Contractor considers the work physically complete and ready for final inspection, I 43 the Contractor by written notice, shall request the Engineer to schedule a final inspection. 44 The Engineer will set a date for final inspection. The Engineer and the Contractor will then 45 make a final inspection and the Engineer will notify the Contractor in writing of all particulars I 46 in which the final inspection reveals the work incomplete or unacceptable. The Contractor 47 shall immediately take such corrective measures as are necessary to remedy the listed 48 deficiencies. Corrective work shall be pursued vigorously, diligently, and without interruption 49 until physical completion of the listed deficiencies.
