I <br /> 2 The rights exercised under the provisions of this section shall not diminish the Contracting <br /> 3 Agency's right to pursue any other avenue for additional remedy or damages with respect to <br /> 4 the Contractor's failure to perform the work as required. <br /> 15 <br /> 6 <br /> 7 1-05.11.RTF <br /> ' 8 1-05.11 Final Inspection <br /> 9 <br /> 10 Delete this section and replace it with the following: <br /> I 11 <br /> 12 1-05.11 Final Inspections and Operational Testing <br /> 13 (October 1, 2005 APWA GSP) <br /> I 14 <br /> 15 1-05.11(1) Substantial Completion Date <br /> 16 <br /> When the Contractor considers the work to be substantially complete, the Contractor shall <br /> I17 <br /> 18 so notify the Engineer and request the Engineer establish the Substantial Completion Date. <br /> 19 The Contractor's request shall list the specific items of work that remain to be completed in <br /> 20 order to reach physical completion. The Engineer will schedule an inspection of the work <br /> 21 with the Contractor to determine the status of completion. The Engineer may also establish <br /> 22 the Substantial Completion Date unilaterally. <br /> 23 <br /> I 24 If, after this inspection, the Engineer concurs with the Contractor that the work is <br /> 25 substantially complete and ready for its intended use, the Engineer, by written notice to the <br /> 26 Contractor, will set the Substantial Completion Date. If, after this inspection the Engineer <br /> I 27 does not consider the work substantially complete and ready for its intended use, the <br /> 28 Engineer will, by written notice, so notify the Contractor giving the reasons therefor. <br /> 29 <br /> I <br /> 30 31 Upon receipt of written notice concurring in or denying substantial completion, whichever is <br /> applicable, the Contractor shall pursue vigorously, diligently and without unauthorized <br /> 32 interruption, the work necessary to reach Substantial and Physical Completion. The <br /> 33 Contractor shall provide the Engineer with a revised schedule indicating when the <br /> I34 Contractor expects to reach substantial and physical completion of the work. <br /> 35 <br /> 36 The above process shall be repeated until the Engineer establishes the Substantial <br /> 1 37 Completion Date and the Contractor considers the work physically complete and ready for <br /> 38 final inspection. <br /> 39 <br /> I <br /> 40 1-05.11(2) Final Inspection and Physical Completion Date <br /> 41 <br /> 42 When the Contractor considers the work physically complete and ready for final inspection, <br /> I 43 the Contractor by written notice, shall request the Engineer to schedule a final inspection. <br /> 44 The Engineer will set a date for final inspection. The Engineer and the Contractor will then <br /> 45 make a final inspection and the Engineer will notify the Contractor in writing of all particulars <br /> I 46 in which the final inspection reveals the work incomplete or unacceptable. The Contractor <br /> 47 shall immediately take such corrective measures as are necessary to remedy the listed <br /> 48 deficiencies. Corrective work shall be pursued vigorously, diligently, and without interruption <br /> 49 until physical completion of the listed deficiencies. This process will continue until the <br /> I50 Engineer is satisfied the listed deficiencies have been corrected. <br /> 51 <br /> 52 If action to correct the listed deficiencies is not initiated within 7 days after receipt of the <br /> I <br /> 53 written notice listing the deficiencies, the Engineer may, upon written notice to the <br /> I 2020 PAVEMENT MAINTENANCE OVERLAY PAGE 13 OF 79 SPECIAL PROVISIONS <br /> WORK ORDER 3727 FEBRUARY 20,2020 <br />
