ORDINANCE NO. An Ordinance modifying and renewing interim zoning regulations related to recreational marijuana businesses and amending Ordinance No. 3407-14. Whereas,the City Council finds that: 1. Initiative Measure No. 502,approved on November 6,2012,modified the State Controlled Substances Act to allow the possession of marijuana for private,personal use and established a system for lawful production,processing,and retailing of recreational marijuana under state law; and 2. Initiative Measure No. 502 and the Washington State Liquor Control Board rules adopted thereunder established licenses for producers,processors,and retailers of recreational marijuana(collectively"marijuana businesses"); and 3. The City has had,at all relevant times,interim zoning regulations such that applicants have had clear notice of local zoning requirements;and 4. To the best of the City's knowledge,the State Liquor Control Board received 27 applications for retail marijuana businesses within the City, 14 applications for processor • marijuana businesses within the City, and 21 applications for producer marijuana businesses within the City(nine Tier-1 applications and twelve Tier-2 applications);and 5. . To date,three retail marijuana businesses have been approved to operate within the City(High Society,KushMart,and Purple Haze) and will not be impacted by the amendments made in this Ordinance unless they change the location of their current business activity; and 6. The City's limited experience with the siting of the City's three retail marijuana businesses has raised additional concerns related to alley access to retail marijuana businesses, separation from residential uses, and public involvement; and 7 The City desires to address these concerns by amending the City's current interim regulations as provided herein; and Page 1 of 8 2
