EVERETT CITY COUNCIL AGENDA ITEM COVER SHEET
PROJECT TITLE:
An Ordinance modifying and 12/31/14 Briefing COUNCIL BILL# CB j 14-( --P)
renewing interim zoning Proposed Action Originating Department Legal
regulations related to Consent Contact Person Colin Olivers
recreational marijuana Action Phone Number (425)257-7012
businesses and amending 12/31/14 First Reading FOR AGENDA OF 12/31/14
Ordinance No.3407-14. 12/31/14 Second Reading 1/7/15
• 1/7/15 Third Reading
1/7/15 Public Hearing
Initialed by:
Department Head
CAA 0(3
Council President r
Location Preceding Action Attachments Department(s)Approval
Ordinance No. 3407-14 Proposed Ordinance Planning,Legal
Amount Budgeted -0-
Expenditure Required -0- Account Number(s):
Budget Remaining -0-
Additional Required -0-
DETAILED SUMMARY STATEMENT:
Through the City's experience with siting several marijuana retailers, several concerns related to allowing
customers to access marijuana retailers from alleys, separating marijuana businesses from residential uses,
and allowing public involvement in certain situation where neighboring residential uses may be specially
impacted. Councilmembers Tuohy and Roberts have requested that the Legal Department draft an ordinance
to address these concerns. This Ordinance attempts to accomplish this task.
The Ordinance is not intended to establish new obligations upon the three existing marijuana retailers within the City,
but is intended to apply to the potential siting of the two additional marijuana retailer applicants currently seeking
licenses from the Washington State Liquor Control Board. While the Ordinance is not presented as an emergency
ordinance, Staff recommends that the first and second readings be combined. This approach will allow the Ordinance
to be adopted in an expeditious manner and will provide the remaining applicants with as much prior notice as is
possible while they continue the process of siting their businesses.
RECOMMENDATION(Exact action requested of Council):Adopt an Ordinance modifying and renewing
interim zoning regulations related to recreational marijuana businesses and amending Ordinance No.
3407-14.
1
