I can't speak to the other <br /> homes in the area and whether they predated the specific porch exception code or possibly predated the zoning code <br /> altogether(1956). <br /> Recently adopted zoning code amendments support that prior interpretation and clarify porch requirements.A <br /> definition for porch was added to the zoning code (EMC 19.04)and states: "Porch"means a covered shelter projecting <br /> from the entrance of a building. The exception section for setbacks was also amended and can now be found in EMC <br /> 19.20.240.A(Table 20-5).The revised exception allows the front setback for porches, decks, stoops, and steps no higher <br /> than 42" above existing grade to be reduced by 50%or 6 feet,whichever is more permissive, and also has standard <br /> design criteria.While we would not consider that second story deck to be a porch, even if it was called a porch it still <br /> wouldn't qualify for that front setback exception due to the height(based on the new code provisions). <br /> On a separate note, I have spoken with the Land Use Manager and we've determined that if you can identify in the field <br /> that the height of the attached accessory structure is consistent with the approved plans then we can avoid doing the <br /> height survey. (If it can't be demonstrated to meet the approved plans then a height survey will be required.)
