• <br /> VV. "Urban Growth Area" or "UGA" means the Southwest Urban Growth Area <br /> determined by Snohomish County in accordance with RCW 36.70A.110 in <br /> cooperation with Everett, as such UGA may be modified or amended during the <br /> term of this Agreement. <br /> WW. "Water Connections" are defined in Section 7.B. (2) of this Agreement. <br /> XX. "Water Main Owner" and"Water Main Non-Owner" are defined in Section 7.E <br /> (2) (a)of this Agreement. <br /> 2. TERM OF AGREEMENT <br /> This Agreement will remain in effect for a term of fifty (50) years, beginning on the <br /> Effective Date. This agreement may be amended at any time by mutual written agreement of the <br /> Parties. <br /> However, as described in Section 8 below, the Parties shall meet during the first quarter <br /> of 2039 to discuss possible revisions to this Agreement. Further, no later than five (5) years <br /> prior to the end of this Agreement,the Parties shall meet to discuss extension of this Agreement. <br /> The Parties may renew and extend this Agreement by mutual written agreement upon such terms <br /> and conditions as the Parties may agree. If such an agreement is not reached, this Agreement <br /> shall terminate at the end of its term. <br /> 3. PERMISSION TO DISCHARGE SEWAGE/CONNECTION POINTS <br /> A. Connection Points. <br /> Subject to the provisions of this Agreement, the District shall have the right to <br /> discharge sewage from the District into the Everett sewer system by existing connections <br /> ("Connection Points") to the Everett South End Interceptor Extension as shown on Exhibit B <br /> attached to this Agreement. . Subject to Everett approval, the District may install additional or <br /> relocated Connection Points at the District's sole expense. Everett has no obligation under this <br /> Agreement to accept sewage from outside of the District's Service Area or to accept sewage at <br /> locations other than Connection Points. . <br /> B. Operation and Maintenance of Connection Points. <br /> Everett shall own,maintain,and operate the Connection Points. <br /> C. Connection Point Flow Monitoring. <br /> At the written request of Everett, the District shall at the District's sole expense <br /> perform a flow monitoring study at the Connection Points that will best measure District sewage <br /> discharge quantity and quality entering the Everett sewer system. Everett may make such <br /> requests no more than once every five (5) years. The District shall begin the flow monitoring <br /> i flow monitoring CS study <br /> study within sixty (60) days after receipt of the request from Everett.
