numeric effluent limitations (see S8. Discharges to 303(d)or TMDL Waterbodies), the <br /> Permittee must,upon becoming aware of the circumstance: <br /> 1. Notify Ecology within 24-hours of the failure to comply by calling the applicable <br /> Regional office ERTS phone number(refer to Special Condition S4.C.5.b.i. or <br /> www.ecy.wa.gov/programs/wq/stormwater/construction/turbidity.html <br /> for Regional ERTS phone numbers). <br /> 2. Immediately take action to prevent the discharge/pollution, or otherwise stop or <br /> correct the noncompliance,and, if applicable,repeat sampling and analysis of any <br /> noncompliance immediately and submit the results to Ecology within five(5)days <br /> of becoming aware of the violation. <br /> 3. Submit a detailed written report to Ecology within five(5)days, of the time the <br /> Permittee becomes aware of the circumstances,unless requested earlier by <br /> Ecology.The report must be submitted using Ecology's Water Quality Permitting <br /> Portal(WQWebPortal)-Permit Submittals,unless a waiver from electronic <br /> reporting has been granted according to S5.B.The report must contain a <br /> description of the noncompliance,including exact dates and times, and if the <br /> noncompliance has not been corrected,the anticipated time it is expected to <br /> continue; and the steps taken or planned to reduce, eliminate,and prevent <br /> reoccurrence of the noncompliance. <br /> The Permittee must report any unanticipated bypass and/or upset that exceeds any <br /> effluent limit in the permit in accordance with the 24-hour reporting requirement <br /> contained in 40 C.F.R. 122.41(1)(6). <br /> Compliance with these requirements does not relieve the Permittee from <br /> responsibility to maintain continuous compliance with the terms and conditions of <br /> this permit or the resulting liability for failure to comply.Upon request of the <br /> Permittee,Ecology may waive the requirement for a written report on a case-by- <br /> case basis,if the immediate notification is received by Ecology within 24 hours. <br /> G. Access to Plans and Records <br /> 1. The Permittee must retain the following permit documentation(plans and records) <br /> on site, or within reasonable access to the site, for use by the operator or for on-site <br /> review by Ecology or the local jurisdiction: <br /> a. General Permit <br /> b. Permit Coverage Letter <br /> c. Stormwater Pollution Prevention Plan(SWPPP) <br /> d. Site Log Book <br /> 2. The Permittee must address written requests for plans and records listed above <br /> (Special Condition S5.G.1) as follows: <br /> Construction Stormwater General Permit <br /> Page 22 <br />
